Living in Windsor - Working in Detroit

Hello,

I am planning to commute between Windsor and Detroit. I have Canada PR and USA H1B. I read lots of posts on this forum, and most of my questions are answered;however I am still looking answers for below questions. Please could you help?

1) Do I need H1B stamp inside passport to get Nexus card? I am in USA for 4 years and never left outside. But I don't have H1B stamp in passport, but only valid I-797 and I-94 documents.

2) If I cross border every day with H1B stamp in passport, with no NEXUS card, do they stamp in my passport every day?

3) Should my US H1B job payroll run on Canada address or USA address?

4) Should I maintain a US residency (by taking an apartment?) for H1B extension and Payroll purpose?

5) Do I need to stay in border city (Windsor or Detroit) already to apply for Nexus card? I am planning to apply Nexus card from Washington DC(Where I reside now) using current Washington DC address, once I get my PR card to hand, but want to apply for Nexus card before I actually move to Detroit. Would it cause any issues?

6) If my employer applies for I-140 when I am in Windsor, what address should I give?

I am very confused with H1B address and PERM/I-140/I-485 addresses and of course pay roll issues.

It would be a great help, if someone could clarify my doubts. Thanks!

Regarding the Nexus card, you may want to contact the Nexus card processing centre directly at:

1-800-842-7647 (Residents of Ontario and the United States)
Monday to Friday, 8:30 a.m. to 4:30 p.m. EST (except holidays)

Regarding your H1B related questions, you may need to contact a U.S. immigration specialist for information specific to your situation.

Hello moderator,

My name is Boban, I got my PR card recently and I am planning to move to Windsor next month. Since your website is more focused on immigrating to and living in Ontario, if I live in Windsor, could I work in Detroit with PR status? Is it possible?

According to the ENF 23 Loss of Permanent Resident Status manual,

"6.4. Day

For the purpose of calculating the number of days to comply with the residency obligation in A28(2)(a), a day includes a full day or any part of a day that a permanent resident is physically present in Canada. Any part of a day spent in Canada, or otherwise in compliance with A28(2)(a), is to be counted as one full day for the purpose of calculating the 730 days in a five-year period."

Additionally, according to the FAQ on the Citizenship and Immigration Canada (CIC) website:


Q11: I travel often because of my work (truck driver, employee for an airline company, etc.). Do I have to declare those absences?

A11: Yes. All absences from Canada, regardless of the reason, must be declared. The only trips you do not have to declare are those where you left and came back to Canada on the same day.
