Hello.

I have been married to my husband for at least two years now.

He's currently studying in Canada. He applied for PR last year in June 2014 for himself and and sponsored me as well.

We both have received our PR, he has landed there but I am in Pakistan and still have to land.

The thing is I have been having some issues with him for quite a long time but did not say anything as I still believe things can be better if I try once I go there.

I wanted to know, once I land there, if things don't work out with him and I have to file for divorce or separation, will he have me deported back?

Or how will it affect my PR status there?

I mean, I have the PR, how will it effect me?

We can appreciate that you would be concerned regarding any possible future changes in your marital status.

According to several CIC representatives, if your husband was the principal applicant, in other words, you were not sponsored by him, then there should be no issue with your PR status if you divorce after landing. He cannot have you deported back.

If you were sponsored, meaning, your husband became a permanent resident first, then he submitted a sponsorship application for you, including signing an undertaking, then that means that there may be issues with your permanent residency if you divorce.

Some sponsored spouses have conditional permanent residence. This means that they must live together with their sponsor in a legitimate relationship for two years from the day they receive conditional permanent residence. The condition ends after the two-year period. It applies to those here were sponsored and whose application was received on or after October 25, 2012 and if they have been in a relationship of two years or less and do not have children in common with their sponsor.

If there are additional questions or concerns, your husband may want to contact the Citizenship and Immigration Canada (CIC) Call Centre directly for some additional information.
