Dear Sir or Madam:

How may I know that my employer has treated me fairly whilst coming up with a severance package?

I have been given 5 months pay + some benefits for my 7 years of service.

Please guide me in this regard.

Hello,

Thank you for sharing your situation and question with us.

You can find some detailed information regarding severance on the Ministry of Labour Website in the Severance Pay section.

Here is an excerpt,

Amount of Severance Pay

To calculate the amount of severance pay an employee is entitled to receive, multiply the employee's regular wages for a regular work week by the sum of:

-the number of completed years of employment;
and
-the number of completed months of employment divided by 12 for a year that is not completed.

The maximum amount of severance pay required to be paid under the ESA is 26 weeks.

You may also want to contact the Employment Standards Information Centre for some additional information here:

GTA: 416-326-7160
Canada-wide: 1-800-531-5551
TTY: 1-866-567-8893

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.
