May I use the 'Spouse or common law in Canada Class' application for my wife how is currently living in Canada with a expired visitors VISA?


I initially sent in the spousal immigration application in September 20, 2017 while my wife had a valid VISA. My application was returned in November 22, 2017 as a result of missing documents. My wife's VISA expired on September 30, 2017.

1. Yes you can, but she/he is not eligible for an Open Work Permit as s/he no longer has status.
