Hello

I am a permanent resident of Canada and currently living in Canada. My PR card expires on 26th March 2019 and as of now (26th Sep 2018)I have only 540 days of stay in Canada as I have travelled out few times in the past 5 years for personal reasons.

So if I continue to stay, I will have 720 days of physical presence in Canada by the 26th of March 2019.

Can I apply for renewal of my PR card with a covering letter stating that I will not leave the country till I meet the residency requirement(In my case April 17 2019 or beyond).

I would appreciate any thoughts on this
Thanks

Hello D,

Thank you for sharing your situation and question with us.

We can appreciate that you would be interested in this type of information.

You can find details about this in the Applying for a Permanent Resident Card (PR Card) - First application, replacement, renewal or to change sex designation (IMM 5445) Guide - Appendix A: Residency obligation.

Here is an excerpt,

Minimum residency obligations

You must meet the residency obligation to get a PR Card.

If you have been a permanent resident for five (5) years or more

you must have been physically present in Canada for a minimum of 730 days within the past five (5) years.

If you have been a permanent resident for less than five (5) years

you must show that you will be able to meet the minimum of 730 days of physical presence in Canada within five (5) years of the date you became a permanent resident.

You may want to contact the IRCC Call Centre directly at 1-888-242-2100 (In Canada Only)

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

1. Don't renew your PR card until you have 730 days of residency in the past 5 years. A "promise letter" won't be any help.

Hi
I am also having same problem.
My date of landing is on 21st Feb 2014. I stayed in Toronto for 429 days till 3rd May 2018. I came back from India on that same day i.e. on 3rd May 2018 & from then onwards staying in Toronto.
I will continue to stay here up to 20th Feb 2019, the day that completes 5 years of my landing or PR become effective. But if I add this additional 294 days [from 3/May/2018 to 20/Feb/2019] then (429 + 294 =) 723 days will result with a shortage of 7 days for minimum days requirement of 730 days.
So what to do in this condition ? Shall I apply for PR renewal now or in first week of March 2019, after staying for additional 7 more days ?
My PR expires on 23rd April 2019 (as quoted on my PR card). will it going to help me in any way?
Pl answer my queries & any possible solutions to this problem
