I would like to find out if there is a need to apply for divorce according to Toronto laws.

We got married in 2013, we only had the record of solemnization which neither of us has in possession now and we never applied for a marriage certificate.

The marriage fell off within few months.

I would gladly appreciate advice on whether this marriage is recognized and need to divorce before getting married again.

Hello,

Thank you for sharing your situation and question with us.

You can find some detailed information regarding getting a divorce in Ontario in our Settlement.Org How can I get a divorce in Ontario? article.

Here is an excerpt,

How do I begin a divorce process?

Before starting a divorce, it is recommended that you seek legal advice from an expert in family law. An expert such as a lawyer can tell you how the law applies to your case and how you can protect your rights. You can find a lawyer or ask for some information and referrals at a Family Law Information Centre in an Ontario family court.

To start the divorce process, you must:
  • Fill out a divorce application.
  • Submit the application at an Ontario courthouse.
  • Pay the required court fees.
  • Follow any court rules and procedures given.

  • There are several costs to getting a divorce in Ontario. For that information, read the answer to How much does a divorce cost? on the website of the Ministry of the Attorney General.

You may want to contact the nearest Family Law Information Centre to speak to an Information and Referral Coordinators (IRCs) to see if they can provide you some details specific to your situation.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

    Hi,

I got married last year in India.Came to Canada, applied for PR and got it early this year.My spouse decided to send the marriage on unreasonable grounds and went ahead and filed for an uncontested divorce. We are in the separation period for a year before filling for a divorce.
1)Is coming divorce in Ontario Canada valid since we got married in India?
2)I have money and property that I have earned before marriage and I want to transfer the money from other country to Canadian accounts? Will it cause any trouble for me in terms of my spouse getting to know about it and claiming for division?
3)Is it advised to wait until filing for a divorce before transferring the money?
    4) Is there any loop hole about the pre marital property division that I could be unaware of and I need to know to safeguard my assets?
