1. No, she would also need a letter from the University that the language of instruction was in English for her course of study.

Thanks @ PMM. I'm assuming also that it may need to be notarized or the letter from the institution on a letterhead suffices?

Thanks!

1. No, doesn't have to be notarized, letterhead should be fine.

1. The OP should note that CBSA, and IAD have lately been looking closely at who is actually accompanying who abroad. Especially where the new Immigrant "lands" and returns immediately with their Canadian spouse to resume work abroad.

Travel to Canada while Applying for Citizenship

I am German, my wife is a born Canadian citizen; we live in Germany.

Our son was born last August and we just applied for his citizenship certificate (since he technically is a Canadian citizen already).

We were told that one is not permitted to travel to Canada on a Foreign passport if his name is in the Canadian Citizenship Database. My son does not have his Canadian passport yet obviously, since he doesn´t have his certificate yet.

So our question is: Is his name already entered into the database, now that we applied for the certificate, hence prohibiting him to travel to Canada on his German passport?

That would be really bad for us because we are planing to visit m wife´s relatives in May in Toronto, and most likely won´t have his certificate and certainly not his Canadian passport at that point.

Or does it mean that he will be added to the database once his certificate has been approved, meaning until then he can enter Canada freely on his German passport?

Any suggestion is appreciated.

Thank you.

1. You have 2 choices, you can apply for a limited validity Canadian passport, as you already have submitted for proof of citizenship or you can apply for a facilitation visa.

Hi,

my wife and i went to Mexico for one week vacation last week from Toronto (we are PR and live in Toronto) when i was doing check in to Air Canada to back to Toronto just realized that My PR card has been expired two months ago so I couldn’t get through the flight and stuck in Mexico but my wife recently got her Canadian passport and backed to Toronto,

then I applied as an urgent PRTD in Vfs Mexico city ,

i am wondering if i can expedite my application or do you how long does it take to IRCC issue PRTD?

Appreciate

1. Very had to expedite an PRTD.
2. Do you have a US visa? If so you could fly to a US city and cross into Canada via non commercial means.

I am a Canadian born citizen who received his medical training outside Canada. I'm married to a US citizen and have a US citizen child. We will all be returning to Canada shortly to continue my medical practice.

What is the expected processing time for my spouse to receive Permanent Residency status that would enable her to work in Canada?

Can she work here while the paperwork is being processed?

Are there any other immigration requirements for my spouse and child to complete before moving here?

Can they move here with me before that paperwork is completed and needed permits received?

Does the 3 month wait period to receive OHIP coverage only start once she receives Permanent Residency status?

Do the same timelines apply to my child?

1. You don't have to sponsor your child, s/he is already a Canadian citizen via decent (you say you were born in Canada) so all you have to do is apply for proof of citizenship for the child.

2. Assuming you will submit an "in Canada" spousal application, the posted processing time is 12 months. You can submit a Spousal open work permit for your spouse with the application, which would allow her to work about 4 months into the process.

3. Yes, they can be admitted as visitors, but if they show up with all their worldly possession, you might run into a "sticky" CBSA officer, who may decide your spouse's intention is to remain permanently, rather than visit.

4. Yes, she is only eligible for OHIP once she is a PR.

Hello, my name is SooJi .

I am currently living in the States for my studies.

I am trying to apply for the Canadian citizenship, but I have a question.

I have lived in Victoria BC Canada for 6 and half years, attended middle, high school and received high school diploma in 2013.

I have read one of the eligibilities of applying for citizenship, saying that if I have spent 2 years of 5 years in Canada prior to my application, it is possible for me to submit my application.

Again, I left Canada in 2013, but I moved to Victoria in 2007 and lived there for 6 and 1/2 years and now trying to become a Canadian citizen.

Please let me know what to do, or what the next steps are, or if there are any necessary documents I need to provide as a proof. Thank you in advance, SooJi.

1. First question is are you are a Permanent Resident of Canada? If not you can't apply for citizenship.
2. If you are a PR, you must reside in Canada for 2 years in every 5 year period. If you left Canada in 2013 and haven't returned, you no longer meet the Residency obligations.
3. To apply for citizenship, you must be a Permanent Resident, have resided in Canada for 3 of the previous 5 years on the date you apply. You obviously don't meet that criteria.

4. If you are not a Permanent resident, then you should be looking at applying for Permanent Residency under the Express Entry. See: https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada.html

1. Once you "land" CBSA then starts the process of cancelling your ETA, and TRV (if you have one) it some times takes only a day or 2 or sometimes a month. You may be surprised when you attempt to reboard your return flight and are refused board as there is no longer a valid TRV or ETA in the system. \
2. To be sure, you will either require a PRTD to fly, or return via a "land" border in non commercial vehicle.

I want to ask if it is illegal to send PR cards by courier?
My PR cards are with my Uncle, and he is not convinced that it is legal.
He advised me to apply for PRTD, which we are planning to do.
We have two questions

1) Is there a way to legally prove to my uncle that it is not illegal to courier my PR cards to me?
2) We landed a few months back and I had to go back to finish my PhD, now my family and me are applying for PRTD document, is there any reason why they could refuse PRTD document?

I would really thank for help regarding this matter. Thanks a lot.

1. There is no law in Canada about sending PR cards abroad, it is done all the time.

2. Have you Uncle courier the cards, saves money rather than the time and expense of getting a PRTD.

3. No reason to refuse, unless you received a Criminal conviction since you left Canada.

I was told since I am living with Canadian citizen days are counted as I am living in Canada.

1. No, you require physical presence in Canada for citizenship. You may count the days accompanying a Canadian citizen spouse for your Residency obligations for maintaining your PR status. You should note lately there have been a couple of cases where it was determined that the PR was not accompanying their Citizen spouse, as the PR had returned to their country of residence to continue with their employment, and it was found that the PR was "not accompanying their Citizen spouse"

Hi,

I want to ask about my permanent resident card.

I came to Canada on a spouse visa in march 2017 and received my PR card in may 2017. I came to my home country in october 2018 and I wish to stay here for about 7 months in a row. Do I need to notify the immigration about it? Would they cause any problem if I stay outside Canada for more than 6 months?

Because before the rule is if you're a permanent resident in Canada you only have 6 months most to stay outside Canada.

So, I'm also asking if this law is still applicable today?

1. Please read the previous posts, there is no 6 month rule. The rule is to meet your Resident Obligations you must reside in Canada for 2 years in every 5 year period. There are certain exceptions, working for Canadian Company, Government, Military, accompanying Canadian citizen spouse.

I also want to ask that If a Canadian PR card holder travels and stays in the US for more than a year with Canadian spouse. And the Canadian spouse goes there on TN and TD visa. Does that time count in the days spent In Canada? Or we will count it as the time spent outside Canada?

1. As long as you are accompanying a Canadian citizen spouse, (as long as there is no question as to whom is accompanying whom) then the days abroad count towards your R.O. They don't count for citizenship though.

If lost CoPR, can people get another one?

If so, how?

Thanks!

You apply for a VOS and pay the fee: http://www.cic.gc.ca/english/information/applications/certcopy.asp

1. Contact the office that issued the COPR with an explanation that the COPR was lost. Send a CSE to the issuing office. (You can't "land" without it)
2. They will require 2 new photos to re-issue a new COPR. There maybe a charge for a replacement.

3. Explain that you intend to "land" in June, it will be touch and go if a new is issued in such a short time frame.
