No Smoking Clause in Rental Agreement

When we moved into our subsidized unit, we signed a rental agreement that included a no smoking in unit or balcony/patio clause. The tenant in the unit beside us also signed a rental agreement with the same clause. Both unit doors mark them as being no smoking.
The neighbouring tenant smokes on his patio constantly. When we call our landlord they tell us that it is up to by-law to enforce it. Is this correct even though it is something signed and agreed to in their own rental agreement?
I have COPD, as well as Asthma, the wind blowing the right way makes this smoke blow right over to our unit, where I am forced to breathe it in.
What are my rights? Where I can I turn for help?
