My Employer Will Not Pay Me - Questions

Hello,
I finished my undergrad at the University of Victoria last summer and I moved to Toronto last month to get a job in the chemistry sector.
I knew the process would take a while, so I got a construction job in the meantime. I was told that i would get paid weekly (cash), but I didn't, so I waited for my money for 2 days and I told my boss that I wasn't going to keep working until I got my money. he gave me a cheque but It had no funds and I've been calling him to get my money but keeps telling me to call him back.
I have pictures of the work I did, text messages and the proof that his cheque had no funds (bank statement), however we did not sign any contract.
Any advice on what i should do?
I have all my papers (post graduation work permit to work full time for any employer, as well as my SIN number)
