Landlord charging for Mini Fridge not in Use

Me and my roommate both have mini fridge's that we are not using, we have them in our unit as storage.

They are not plugged in and the inside of the fridges are completely empty.The landlord did an inspection on our unit and fined us both $200 for having unauthorized appliances.

The lease says that we need to write a message to the landlord PRIOR to use.

As we had no intention of using the fridges we did not send a written message.

The lease also states "If any of the above equipment is operating in the suite without written approval of the Landlord the Tenant will be charged 200$ per infraction and the equipment will be removed from the suite immediately". The fridges were not operating.

I am thinking of bringing this up with the landlord.

I am risking rubbing him the wrong way so I would greatly appreciate having a second professional opinion. My main concern is he will say its my word against yours.

Who has the burden of proof? and am I in the wrong for assuming that prior means before you are about to do something?
