Rental Guideline Exemption

The Landlord/tenant Board informs over phone that rental units (including basement apartments built legally) which came into the rental market after November 1, 1991 do not fall under the rent guideline purview. Is this interpretation of Sec. 6.2 of the Ontario Rent Control Act correct? Thanks.

Here is an excerpt,
It is important to note that the rent control guideline does not apply to new rental buildings. A new rental building is a building that was occupied as a residential unit for the first time starting November 1991; like a new apartment or condo building or a converted factory that is now an apartment building.

Thank you for your reply.
Does the word apartment include basement apartment (where I live) in a detached 2-storey house. Sec. 6.2 a, b and c of the 2006 Rental Act are not saying this and there are no case studies to interpret Sec. 6.2
