MEX Citizen w/ Criminal Record in USA

Hello!

My sister (US citizen) and brother-in-law (MEX citizen) have been married for 18 years. They tried many times to get his US citizenship but were never successful and ultimately gave up after spending thousands of dollars on lawyers with no results. Many MEX immigrants find a Hispanic US citizen who needs some extra cash, pays them to work under their name, and begins living as that person while paying them a little here and there. My brother-in-law lived like this for many years before getting caught and even though the other person willingly agreed, was sent to prison for identity theft. He got out early on good behavior and was deported leaving his wife and child behind. Other than this, the only legal trouble he's been in was a DUI.

Can my sister move to CA, gain citizenship, and then later my brother-in-law move there and gain citizenship as well?

Your sister will have to look at what the options are available in order to immigrate to Canada.
