1. Yes the child has to be declared as non accompanying. IRCC will also want to have the child medically examined or a statement showing the mother refuses to have him/her examined.

But one more question, do we need to give or provide a letter that the custody is with the mother.. Or the child address would be enough

Yes, to legally immigrate the kid, you will have to declare it.

1. It doesn't matter, he has to declare the kids, submit proof the mother has custody and either have the kids medically examined or a statement from the custodial parent that they refuse the medical and they realize that the children can't be sponsored in the future. You don't declare the children, that is misrepresentation and can result in a ban from Canada for 5 years.

Thank you for the response,it's kind of confusing for me..
We are trying to gather all the documents and forms that we needed for my husbands application.. With regards to the letter refusing the kids to be examined.. Do we need to wait for the request of medical exam or can we attached it along with my husband application..

It's me again.. I apologize for so many questions.. If the custodial mother give an affidavit that the custody is with her.. Do my husband still need to fill up imm5604..

1. As the children are NOT emigrating the form is not required. If the Mother had custody of the children and the children were emigrating, then the mother would have to complete the form.
