Hello,

Shortly after gaining my PR status (and card), my Canadian spouse and I moved abroad, where we have been living together for the past 8 years.

During this time my PR card expired.

Before we visited Canada two years ago on vacation, I applied for and recieved a PR travel document so that I could enter Canada.

While in Canada on vacation, I applied to renew my PR card - a few months later I got a letter requesting that I attend an interview in person before the card would be issued.

I was not in Canada during the time window for the interview, so I did not attend.

I am now searching for a job in Canada, as our family would like to return to live there permanently.

However, when applying for a job, I see that I will need to show proof that I am legally entitled to work in Canada.

From my understanding, I am still eligible for my PR status on the basis that I have been living with my Canadian citizen spouse outside of Canada for employment purposes (I supplied this proof when applying for my PRTD).

We are planning to visit Canada again this summer on vacation, and I had hoped that I would be able to renew my card whilst I am there.

To do this I would need to apply some months before arriving, so that I could hopefully attend an interview while there; however, I see on the website I must be present in Canada to apply for the PR card.

My questions are
1. how can I show proof that I am eligible to work in Canada without having a valid card?
2. Can I apply for the PR card from outside Canada?

I am in a situation now where I would like to move permanently to Canada, but cannot do so until I have a job in Canada, and I cannot apply for the job because I can't show proof of my status in Canada (even though my PR status is still valid).

Thank you in advance for your help.

Regards, Ruth

Hello Ruth,

Thank you for sharing your situation with us.

Regarding working in Canada, in most cases employers do not request to see a valid PR card.

They require that you have a valid Social Insurance Number (SIN). You also need it to work in Canada.

According to the Steps to Justice website it is:

A SIN is a 9-digit number that you need to work in Canada or to use government programs and get benefits.

According to the Service Canada website employers must:

Request each new employee's SIN within three (3) days after the day on which their employment begins.

IT also states,

If a new employee does not have a SIN and is eligible to work in Canada, instruct the employee to apply for a SIN at a Service Canada office. If the employee's application and identity document(s) are in order, he or she will receive a SIN in one visit.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.
