We live in a duplex and share some areas with tenant such lobby and backyard. Lease agreement signed by tenant specifies NO PETS since I am allergic to cats. She has brought 2 cats to the house. What to do??

Hi there,

Thank you for sharing your question with us.

You may find helpful information in the thread My written agreement clearly states NO PETS. The tenant says she’s allowed to have a dog from the Landlords Self Help Centre. Here is an excerpt:

If your tenancy agreement prohibits pets, that provision is void and not enforceable. Tenants are allowed to have pets. If problems occur as a result of the pet the legislation provides a variety of remedies.

You may want to contact the nearest Community Legal Clinic for some legal advice regarding your situation and agreement. You can find the nearest one by using this tool on Legal Aid Ontario. If you do not qualify to receive services from a Community Legal Clinic, please contact the Landlord and Tenant Board directly.

If you have any additional questions, please feel free to post them here.

We hope this information is helpful.
