Hello,

I have applied permanent residency through CEC express entry stream in August 2020. I'm still waiting for the decision and it's been more than six months. The situation is that I need to go to India for three Weeks and I'm confused whether I will need Permanent residence travel document if I get the confirmation while I'm in India?

Here is my current status,
Work permit- expires in 2022
Valid TRV- expires in 2022.
Inland PR application- Canadian experience class.

I consider two situation,

1) I get confirmation before going to India. In this case, will I be granted back to Canada with work permit and TRV? Will I need Permanent residency travel document? Do I need to inform IRCC about my plan?

2) I get confirmation after getting to India. In this situation, will I need Permanent residency travel document? Will I need to inform IRCC about my plan? Will I be consider as Out-land applicant and have to follow the same landing procedure? Will I need to send passport to Local VAC for One time entry Visa? Or work permit will do?

I am really confused, I have to go to India and I feel like I'm stuck. Any advice and information would be great help.

Thanks.

Hi there,

Thank you for sharing your situation and question with us.

If you receive confirmation for permanent residency, are abroad, and do not have a PR card, you will have to apply for a Permanent Resident Travel Document. Generally, permanent residents can only use a valid PR Card or PRTD to return to Canada. Usually, a Travel Document can only be used once. You may want to read more about travelling without a PR card in this Settlement.Org article, I need to leave Canada but do not have my PR card yet. What should I do?

Here is an excerpt:
The only official documents that permanent residents of Canada can use to travel back to Canada on a commercial carrier (by air, land or sea) are the PR card or a Permanent Resident Travel Document (PRTD), also known as a Travel Document (Permanent Resident Abroad) issued by a Canadian visa office abroad.

If you are entering Canada in a private vehicle, such as your own car, and you do not present your PR card, you may be able to show other immigration documents.

If you are outside of Canada or plan to leave Canada and have immigration questions, you may want to contact the IRCC Call Centre or use their web form for advice and to confirm this information.

You may also want to contact a Lawyer or a reputable, registered Immigration Consultant for some advice and assistance with this process.

If you have any additional questions, please feel free to post them here.

We hope this information is helpful.

Sincerely,

Your Settlement.Org Team
