Do I need a new rental agreement?

Good day,
If both landlord and tenant agree to a new a month-to-month rent that is above guideline (and above 3%), is there a way to solidify that agreement with a legal document? Perhaps a new rent agreement?

The advice you receive may vary depending on the terms of your agreement and type of living arrangement (i.e. roommates, landlord/tenant, etc.).
