Unaware of Potential PR until Detained at Airport

Thank you for sharing your situation and question with us.

We can appreciate that you would be concerned about this situation and would want to resolve it.

According to some CIC representatives, if you are able to contact the Citizenship and Immigration Canada (CIC) Call Centre, they would be able to search to confirm whether or not you are a permanent resident.

As you may know, you cannot call the toll-free number from outside of Canada.

However, we have had some of our users previously state that they have been able to contact CIC from abroad by dialing 1 613 944 4000. Listen to the options to get to CIC.

Please note though that some have reported that it did not work for them or that it is no longer working.

You may want to give it a try.

Long distance charges will apply.

The CIC representatives also stated that the way you could initiate the process of relinquishment, if in fact you were a permanent resident, would be by trying to apply for a Permanent Resident Travel Document (PRTD) at the nearest Canadian Visa Office.

They stated that you would have to indicate in your application that you are unaware of your status and that you are aware that you are applying for the travel document knowing that it will likely be refused.

In these cases, they are generally refused and then offered an option for appeal. Refusing the appeal option will mean loss of permanent residency.

Again, as they suggested, you may want to try and contact the CIC Call Centre if possible or the nearest Canadian Visa Office.

If your documents were accepted at the time and the translation was accurate it would seem that the translation is still acceptable and that the content has not changed.

PR card Stolen and PR card Replacement

We can appreciate that you would be concerned about this. We are sorry that you have experienced this.

In the past we have asked this question to CIC. According to a CIC representative, it could cause processing delays if you are unable to provide your old passport (showing entry & exits ). This is because they will have to verify whether you have met the residency requirements in another way.

The representative advised that you include strong supporting documentation when you submit your PR Card renewal application, to prove your physical presence in Canada during this time period.

In addition to what you have suggested, you could also include pay stubs, bank statements, utility bills, credit card bills (they are interested in where you made purchases, not what you bought), cell phone bills, etc.

In terms of leaving Canada before being able to renew your PR card, you can find some information in our our Settlement.Org Do I really need a PR card to travel back to Canada? article.

Here is an excerpt,

If you plan to return in a commercial vehicle, like a plane or bus

If you plan to return to Canada in a commercial vehicle — such as a plane, train, boat or bus — you must apply for a travel document at a visa office outside Canada before you return to Canada.

You should also check with the commercial operator (for example, the airline or bus company you will be using) to see what documents they need.

If you return in a private vehicle, like your own car

If you return to Canada in a private vehicle, such as your own car, you do not need a PR card. You can use your Record of Landing (IMM 1000) or Confirmation of Permanent Residence (IMM 5292 or IMM 5688) instead.

You would have been given these documents:

-if you applied from overseas: at the same time as your visa, or
-if you applied from within Canada at your local visa office when you landed.

An officer will ask you questions to make sure you meet all of the residency requirements before they allow you to come back to Canada.

The practice of dentistry is regulated in Canada. In order to practise the profession or use the title of dentist or dental surgeon, you must be licensed as a member with one of the provincial/territorial regulatory bodies. These bodies set the standards for entry into the profession of dentistry and for issuing licences to those who meet the established standards of qualifications and practice. Once you know where you will settle and work, you should contact the appropriate regulatory body for information on licensing procedures (see list below).

All provincial and territorial regulatory bodies recognize the certificate of the National Dental Examining Board of Canada (NDEB). For more information on the NDEB exam and certificate, you may contact:

In order to write the NDEB exam, an individual must be a graduate of an accredited program in either Canada or the United States of America (USA). Currently reciprocal agreements do not exist with other countries. Graduates of dental programs outside of North America must take a two-year qualifying program. .

"Homeopathy is now a Regulated Health Profession in Ontario. This means that all homeopaths will have to follow the rules of entry to practice standards of practice and competencies as will be outlined by the Regulatory College of Homeopaths. All practitioners will have to be members of the College of Homeopaths if they wish to practice Homeopathy in Ontario. In anticipation of the future rules and regulations, OCHM is committed to provide upgrading, bridging and continuing education courses in homeopathy and health sciences to support homeopaths in fulfilling their membership requirement."

According to this tool and according to the information you have provided us, it sounds like your roomate may be considered a "licensee". Here is an excerpt,


"You are considered a "licensee" and the person who rents the place to you is a "licensor". The law of landlord and tenant does not apply. Neither the Commercial Tenancies Act nor the Residential Tenancies Act applies to you. The law about licensees is mostly judge-made law.

A licensee has a limited right to occupy the premises for a limited period of time. The courts will look at many factors to determine whether a person is in a landlord-tenant relationship or a licensor-licensee relationship. There is no simple test. Two common situations when you would likely be considered to be a licensee are:

*if you share a house or condominium unit (including a bathroom or kitchen) with the owner or their child, parent, spouse, or their spouse's child or parent
*if you rent a room in a house, apartment or condominium unit from a person who is a tenant living there, and you share the space with that person.

As a licensee you have very little legal protection. You can be evicted:

*without notice if you don't pay rent; or
*with notice for any reason or even for no reason. The amount of notice required is usually equal to your rental period (often one week or one month).

It is often a good idea to get a written agreement before moving in. You should include in this agreement what will happen if you want to move out or if the person you rent from wants you to leave. If there is a dispute between you and the person you rent from, and you cannot settle it between yourselves, you may have to go to court. Depending on the type of dispute, you may be able to go to Small Claims Court or the Superior Court. It is very unlikely the court would stop you from being evicted, but you may be entitled to monetary compensation in some situations."

According to the Citizenship and Immigration Canada (CIC) Call Centre, it is important that she try and contact the Government of Cambodia in order to try and get her birth certificate.

This way, when she attends the interview next week, she can state to the Citizenship Judge that she has made an effort to try and get it from the Government of Cambodia.

The Citizenship and Immigration Canada (CIC) Call Centre agent also suggested that she try and take whatever documentation that she does have available such as her passport and any other national identification.

You and your client may also want to contact the Citizenship and Immigration Canada (CIC) Call Centre directly to confirm this information and for additional information.

According to the Operational Manual ENF 23 - Loss of Permanent Resident Status,



7.5. Accompanying a Canadian citizen outside Canada

R61(4) provides that each day a permanent resident is outside Canada accompanying (that is,ordinarily residing with) a Canadian citizen constitutes a day of physical presence in Canada,provided that the Canadian citizen they are accompanying is a spouse or common-law partner or parent. In the case of a permanent resident outside Canada accompanying a Canadian citizen, it is not necessary to determine who is accompanying whom, nor is it necessary to determine for what purpose. In other words, under A28(2)(a)(ii) and R61(4), as long as a permanent resident is accompanying a Canadian citizen, the intent and purpose of their absences are not relevant as the residency obligation is met.


So from the situation you have described, each day of your husband accompanying you, a Canadian citizen, outside Canada, constitutes a day of physical presence in Canada for your permanent residence requirement. It is interesting to note that it also states,

In the case of a permanent resident outside Canada accompanying a Canadian citizen, it is not necessary to determine who is accompanying whom, nor is it necessary to determine for what purpose. In other words, under A28(2)(a)(ii) and R61(4), as long as a permanent resident is accompanying a Canadian citizen, the intent and purpose of their absences are not relevant as the residency obligation is met.


According to the Citizenship and Immigration Canada (CIC) Call Centre, you may want to have the type of documents you have stated, as well as items such as any receipts you may have from that time period, in the event they are requested when you do re-enter Canada.

Writing a letter of invitation does not mean you are legally responsible for the visitor once he or she gets to Canada. You should still write the letter in good faith. You must tell the truth and plan to keep the promises you make in the letter.
