Hello,

Thank you for sharing your question and situation with us.

You may be able to find some helpful information in our Settlement.Org article here, Where can I take ESL classes? You may have to find out which you are eligible for by contacting them as some of them have eligibility requirements in relation to status in Canada.

You may also want to dial 211 on a phone for free and speak to an information and referral specialist. 211 is a free, confidential service that is available 24 hours a day, 7 days a week. They will also be able to help connect your mother with employment services to help her find work.

If the medical exam you are looking to complete is in regards to an immigration application, you may want to confirm with IRCC about the timeline. In the IRCC article, Medical exams for visitors, students and workers:

Getting an exam after you submit your application
We’ll send you instructions on how to get your medical exam done. You must go for your medical exam within 30 days of receiving these instructions.
If you don’t follow these instructions, we may refuse your application.

We hope this information is helpful, please follow up with us if you need any further information.

Sincerely,

About revoking a name change

Hi there,

Thank you for sharing your question and situation with us.

With a name change, it is important that all of your government-issued identification has your updated name. You will want to fill out #4 with the name that is on the documentation you are submitting (record of landing, copr, or previous PR card). You only need to fill #5 if your name is now different to the name on your previous immigration document. I hope this information is helpful, please follow up with us if you have any further questions.

Urgent Land crossing with expired PR card

Hello,
I really hope someone can provide advice! I am a permanent resident of Canada but stupidly let my PR card expire while out of the country for a family emergency. I have read that I could potentially bypass the PRTD requirement by travelling to the US and crossing the border in a private vehicle. Can anyone shed light on whether I'm likely to be allowed across the border if I do this? My PR card expired a few days ago, I can show my Ontario driver's licence and health card. I do not have any original landing documents with me but could provide proof of employment (eg. Job offer letter, pay statements) on my phone.
Thank you so much in advance!

Hello There,

Thank you for sharing your situation and question with us.

You will still need to provide travel documentation to enter Canada at the U.S. border. Based on information on the IRCC website, your mother will likely need to apply for a Permanent Resident Travel Document to return to Canada.

According to the IRCC Help Centre article What happens if my permanent resident card expires while I am outside Canada?:
If you’re outside Canada and don’t have a valid PR card, you need a permanent resident travel document (PRTD) to return to Canada. You can only apply for a PRTD from outside Canada. If you try to return to Canada without a PR card or PRTD, you may not be able to take your flight, train, bus or boat to Canada.

It is also worth noting that not meeting your PR residency requirements doesn’t mean an automatic loss in PR status, you may want to speak to a reputable and registered immigration consultant or an immigration lawyer about travelling back to Canada without a valid PR card. You may also find helpful information in the discussion forum thread How to calculate days for PRTD application?

We hope this information is helpful. If you have any additional questions, please feel free to post them here. You may also want to contact the local visa office or IRCC via web form to get more details about her specific application and what kind of supporting documents she may require.

Hello.

Hope this message finds you well.

I am trying to a answer of my inquiry but has been unsucessfull.

I have a child who will be 3 years and 5 months in September , 2022. I wanted to enroll him to Juniror Kindergarden. After some research, I learned that he has to be at least 3 years and 8 months old to be eligible for JK in the public school.

However, if I wanted to enroll him in a JK class in a private school, is there such a restriction? I really wanted to start school from school this year because he is ready. But, I am not sure why. Can you help in providing some information in this regard?

Thank you.

Hi there,

The answer may vary depending on the private school you contact, you may also want to explore montessory and pre-school options for your child this year. It may also help to connect with a community resource navigator at 211 to narrow your search. 211 Ontario is a free, confidential service.

Hello There,

Thank you for sharing your situation and question with us.

You have a few options in your situation. You may want the advice of a reputable and registered immigration consultant or an immigration lawyer familiar with immigration law for advice regarding your situation.

Here is an excerpt on the eligibility criteria for applying for citizenship from the article, How do I apply for citizenship?:
In order to apply for Canadian citizenship you must:
  • Provide proof that you know how to speak and write in 1 of Canada's official languages (either English or French)
  • Be a Permanent Resident (PR)
  • Have lived in Canada as a PR for at least 1,095 days out of the 5 years before you apply
  • Have filed your taxes for at least 3 years during the last 5 years and any income tax you may owe must be paid

Hi there,

Thank you for reaching out to us about this situation, we appreciate your interest in this information.

According to StepstoJustice:

It is your landlord's job to repair and maintain your home. Your landlord must fix or replace anything that is in bad condition or does not work properly.

This includes things that came with your place, such as appliances like a fridge or stove. It also includes common areas, like parking lots, elevators, and hallways.

It doesn't matter if your lease or rental agreement says something different. It doesn't matter if you knew about the problem when you agreed to rent the place. The law says your landlord is responsible.

It is best that you contact a community legal clinic for some advice regarding your situation. You may also wish to call the Landlord and Tenant Board at 1-888-332-3234 or 416-645-8080 (in the GTA) for information specific to your situation. The landlord and tenant board resolves disputes between residential landlords and tenants.

It may also help to connect with a community resource navigator at 211 to narrow your search. 211 Ontario is a free, confidential service.

Hi there,

Thank you for sharing your question and situation with us.

You may be interested in IRCC’s Physical Presence Calculator as a resource to help you calculate the physical presence requirement. The FAQ section has examples and scenarios that are particularly helpful.

You may also find helpful information in our Settlement.Org article What are the residency requirements for permanent residents (PRs)?
To meet these residency obligations, you must be physically present in Canada for at least 730 days (2 years) in every 5-year period.
The 5-year period is assessed on a rolling basis. For PR renewal, Immigration, Refugees and Citizenship Canada (IRCC) will look back at your time in Canada over the previous 5 years from that date. You may also find helpful information on this matter in the previous discussion forum thread, When does the 5-year period begin?

We hope this information is helpful. You may want to seek the advice a reputable and registered immigration consultant or an immigration lawyer for information specific to your situation. You may also wish to contact the local visa office or IRCC via web form for general information and advice regarding PR renewal.

If you have any additional questions, please feel free to post them here.

It sounds like your daughter is considered a month-to-month tenant, and according to StepstoJustice's article "Who is responsible for repairs and maintenance?":
It is your landlord's job to repair and maintain your home. Your landlord must fix or replace anything that is in bad condition or does not work properly.

This includes things that came with your place, such as appliances like a fridge or stove. It also includes common areas, like parking lots, elevators, and hallways.

It doesn't matter if your lease or rental agreement says something different. It doesn't matter if you knew about the problem when you agreed to rent the place. The law says your landlord is responsible.

Still, landlords must follow a process to evict a tenant in Ontario. The landlord cannot physically remove them from the home. They must file an application with the Landlord and Tenant Board first and follow the proper eviction process. In most cases, the Landlord and Tenant Board will hold a hearing, and if the board decides that you can be evicted, only the Sheriff has the power to physically evict.

We hope this information is helpful, please feel free to reach out to us with any further questions.

How to Cross Border after Citizen Oath ceremony

Moderator

Hi there,

Congratulations and thank you for sharing your situation and question with us.

According to IRCC, once you are granted citizenship, you are no longer a permanent resident and your PR card will no longer be valid. Her PR card will be collected at the citizenship ceremony. To apply for a passport, you will need to show Service Canada the original copy of your proof of citizenship, when she is sworn in and has her proof of citizenship, she can apply for her passport with that documentation. You can find more information about how to apply for your passport in this guide.

While Canadian law allows you to hold two or more citizenships, you don’t need to apply for dual citizenship, and there is no related certificate. Canadians are allowed to take foreign citizenship while keeping their Canadian citizenship. Every country decides whom it considers to be a citizen. If more than one country recognizes you as a citizen, you have dual citizenship. You may want to ask the embassy of the Phillipines about its rules regarding dual citizenship and their passport application process as a Canadian.

I hope this information is helpful, please follow up with us if you have any further questions.

Sincerely,
