Hi,
My parents and i moved to Canada in 2009, i was 10 at that time. In early 2011 we moved back. As i was a minor I didn't have much choice but to move back with my parents as i couldn't stay alone. And as we didn't go back our PR cards expired.

Now, I'm 18 and my grade 12 will finish in a few months. I plan on moving back to Canada after finishing highschool, can i still get my PR status back ? If yes, what's the procedure and how long do i have(like till what age) for applying.

As you know, there is a residency requirement for Permanent Resident Status. Since you have been away from Canada for so long, you will not have met this requirement.

However, your PR status needs to be formally removed. The following is from the Immigration, Refugees and Citizenship Canada (IRCC) website


Losing your permanent resident status does not happen automatically. You cannot lose your permanent resident status simply by living outside of Canada long enough that you don’t meet the residency requirement. Unless you have gone through an official process, you have not lost or given up your permanent resident status, even though you may not be eligible to return to Canada as a permanent resident.
You may lose your permanent resident status if:
You may lose your permanent resident status in one of the ways described above if:
  • you do not live in Canada for two out of five years;
  • you are convicted of a serious crime and told to leave Canada; or
  • you become a Canadian citizen.
You do not lose your permanent resident status if your PR card expires.


We would recommend that you contact Immigration, Refugees and Citizenship Canada (IRCC) about your options for returning to Canada. You may need to apply for a new visa or enter through another immigration pathway in order to be eligible to regain your PR status.

Hi,
Thank for the reply, but a few forums and an Immigration consultant told me that i could apply for a PRTD on H&C grounds as i was a minor then and am trying to go to Canada right after attaining the age of 18.
Is this correct ?

Hi,

I'll be flying back to Canada on the basis of a PRTD in June 2017.


My PR Card(issued in Vancouver) had expired in October 2013, I have a SIN card(starts with '7') but it must be in dormant state as I didn't use it after I moved back to India.

Me being a minor(9) when they(PR and SIN cards) were issued doesn't make any difference right ?

I wanted to know, for renewing my PR card, do I need to be physically present in Canada ?


Can't I file the PR renewal application(IMM5444E) 2-months before going to Canada ie in April or May 2017 ? and upon reaching collect my card.

My aunt lives in Vancouver, can I provide her address in the application form ?


And later collect it from her ?

The CIC website states that I need to mail/courier the IMM5444E form to Sydney, Nova Scotia(http://www.cic.gc.ca/english/information/offices/canada/sydney.asp) !! Is it the only choice I have, even If I decide to renew the PR card while physically being present in Canada.

I need the PR card to be renewed when I return to Canada, So that I can apply for reactivating my SIN card. This way I can try to find work as soon as possible. And reactivating SIN card is not possible without a PR card.



I've read(on this website) that PR takes more than 93 days to get renewed and sometimes upto 6 moths, how will I manage to stay without work for such a long time, If I need to be physically present in Canada to renew it :/

By the way, How long does it take to renew a SIN card ?

Hi,
Thanks for the reply.
You will be asked to present some identification such as a Canadian Birth Certificate, Canadian Citizenship Card/Certificate, PR Card, Confirmation of Permanent Residence (COPR) etc.


Can't I use my Indian passport for identification ? If not that, will my expired PR card count ?

Another thing, This is what my COPR looks like(the format) http://www.go-to-quebec.net/page/imm5292.jpg This isn't exactly like mine, but it kind of resembles it.
There's a -B written on the top right corner and IMM 5292 (CON) B (06-2004) written on the bottom left of my COPR.
Will it work as a proof of identity ?
