Hello,

According to the IRCC website, if you’re outside Canada without a valid PR card, you need to apply for a permanent resident travel document (PRTD).
BUT, to keep your permanent resident status, you must have been in Canada for at least 730 days during the last five years. These 730 days don’t need to be continuous. Some of your time abroad may count towards the 730 days.
https://www.canada.ca/en/immigration-refugees-citizenship/services/new-immigrants/pr-card/who-can-apply.html

Please check the following link answering the question:Can I lose my permanent resident status?
https://www.cic.gc.ca/english/helpcentre/answer.asp?qnum=1468&top=10

Reasons you may be inadmissible to Canada:
failure to comply with any provision of IRPA
Examples of failure to comply with IRPA include:

Permanent residents who haven’t lived in Canada for the required amount of time

My dates in Canada are as follows

March 28 to May 8 2018

Sept 16 to sept 30 2019

Thank you

Hello,

It all depends on the "Return shortly" because I believe based on the dates you provided , you still have time to return to Canada and meet the 730 days residency requirement. I believe as of today, you spent 1063 days outside Canada.
According to the IRCC website:
"To keep your permanent resident status, you must have been in Canada for at least 730 days during the last five years. These 730 days don’t need to be continuous. Some of your time abroad may count towards the 730 days."

tax file obligation on citizenship application

Hi,

I am trying to apply citizenship application.
I have been in permanent resident position for 5 years
Problem is I filed the tax return in Canada for recent 3 years.
I did not file for 2 years, b/c I had to work in the USA and returned to Canada with job.
It seems to me that I had no residential tie in Canada but PR position for the 2 years.

If I apply now, is it possible whether citizenship officer delays or rejects my application by helping CRA to investigate my case?

Regards

Hi,

According to IRCC, you may need to file taxes in Canada for at least 3 years during the 5 years right before the date you apply.

My family first land Canada on Jun.28, 2018 as permanent residents. Our PR card was issued to us 1 year later and will expired on 24 Jul. 2024. We are now in Hong Kong. May I know when is the last day we are eligible to come back to Canada as permanent resident. Up to date, my family only stayed in Canada for two summer, about 60 days. If we don't come back this summer, we won't be able to fulfill the residency requirement of 2 years in Canada during 5year period.
Can we still entre Canada before the expiration of PR card (Jul 2024)?
Due to the pandemic, we are very hesitate to travel back to Canada, especially this year.
Look forward to receiving advice from you soon.

Hello,
It is not all about the expiry date of your PR card. In some instances, the PR card can still be valid, but the holder was outside Canada for more than 4 years. So, even if with one year remaining in the PR card, its holder can be challenged at the border if they decided to enter Canada since the remaining one year on the PR card would not be enough to meet the 730days residency in Canada.
What you should know is that even if you don't meet the residency obligation, you are still a PR until an official decision is made on your status.

Is it possible to send renounce application online?

Please advise me

Hello,

https://www.cic.gc.ca/english/information/applications/guides/5781ETOC.asp
"If you renounce your permanent resident status, you will permanently change your status in Canada as of the day your application is approved by an officer. You will not be able to appeal the decision to the Immigration Appeal Division (IAD). You will no longer be a permanent resident of Canada. You will no longer be eligible to apply for Canadian citizenship. Any application for Canadian citizenship that is still in process will be refused."
You probably need to think things through carefully, and maybe seek a legal advice.

According to the instructions available in the application guide regarding Applying to Voluntarily Renounce Your Permanent Resident Status,
If you are 18 years and older you need to complete the form Application to Voluntarily Renounce Permanent Resident Status (IMM 5782) and sign it after reading and clearly understanding the declaration and the consequences of renouncing to your permanent residence status.
Based on the Instruction included in the application guide 5781, there is no option for an online application.

My wife landed 4 years ago as a permanent resident sponsored by me but we moved back home as could not get jobs we like.

Now her PR card is expiring and due for renewal and I understand that application must be made inside Canada.

However, as per step 4 in the application process, it says applications need to be mailed in - https://www.canada.ca/en/immigration-refugees-citizenship/services/application/application-forms-guides/guide-5445-applying-permanent-resident-card-card-first-application-replacement-renewal-change-gender-identifier.html#5445E7 .

Does it mean applications for renewal *cannot* be made in person? And if so, does it mean we need to come back to Canada to mail in the application? Or can we sent the completed application to my relatives in Canada and ask them to mail it to IRCC? We are okay to come back to submit the renewal application if we can make an appointment to submit it in person.

    Many thanks and regards.

PR renewal application - dates of entry and exits?

    Lahbib70
    Hello,

Based on my understanding, both the online and the paper applications for PR card renewal require that you enter details of all your absences from Canada. The online application won't allow you to go further if you check yes for the question 5.1 Have you travelled or lived outside Canada in the past five (5) years? without entering the details of your last five years absences from Canada. As for the paper application, if you check yes to the question about your last 5 years absences and did not enter the details of your absences, your application would be considered as incomplete and there is high probability it would be sent back to you for that reason.

Approved PR card renewal or replacement applications result in either a 5-year PR card being issued or, in exceptional circumstances [subsection R54(2)], a 1-year PR card. Applications missing information and/or deemed ineligible will be cancelled and returned unprocessed, with fees refunded as applicable.

    Hello,

According to my understanding of the situation you described. If your daughter is Canadian by naturalization, in this case it would be more logical she submits an application for Canadian citizenship certificate for her children.

For renewing a PR card online, it specifically states that I can "upload a picture from my phone or computer." But then the next section asks for an upload of the BACK of the PR photo, where you are supposed to have the address of the studio where the picture was taken.

I am using an online tool which creates the photo for you with the needed dimensitons. Therefore, there is no address to write on the back and no stamp. What should I do?

    Thank you.

    Hello,

As you surely noticed that IRCC clearly stated that "You need to upload a photo of you taken within the last 12 months. We’ll use it to make their permanent resident card" Then the applicant is invited to either upload the photo from the computer or take the photo with your mobile device. In the first choice, the photo to be uploaded can be a photo that the photographer took and then sent you a digital copy via email that you can save on your computer to upload later. The second part is when you have the actual photo (Paper)taken within the last 12 months, and you can take a photo of it with your phone (Both sides) then you can upload them in your PR portal.

    Hello,

The system was built in a way that you can use only once any type of supporting documents to upload. To satisfy this requirement when you have many documents to support that specific requirement, you need to merge all the documents in one document then upload it. You can use one of the many softwares available online to do that or you can scan multiple pages of your supporting documents as one PDF document (Just keep an eye on the size)

    Thank you.
