Definition of Sibling for express entry

Hi All,

I have a query i want to claim 15 CRS Sibling points for my Sister who was adopted by my uncle. As per definition of Sibling available on CIC i think i am eligible as she is biological child of my parents.. can anyone comment on this from Legal Perspective

Points for sibling in Canada31 (1) Fifteen points may be assigned to a foreign national if either they or their accompanying spouse or common-law partner has at least one sibling who is
  • (a) 18 years or older;
  • (b) a Canadian citizen or permanent resident; and
  • (c) living in Canada.
Clarification(2) For the purpose of subsection (1), a sibling of a foreign national or of the foreign national’s accompanying spouse or common-law partner is the biological or adoptive child of
  • (a) their father or their mother;
  • (b) their father’s or mother’s spouse; or
  • (c) their father’s or mother’s common-law partner.

Everyone, Happy to inform that IRCC accepted DNA report for my blood sibling and I got PPR finally.

I can answer just the last one, you have to wait till May for your siblings PR. With sibling PR, you will get additional points. At this time, your brother's status cannot help you to get additional CRS points.

Hi Manav, I was also in same situation, In fact I didn't even have the birth certificate, so I attached DNA report. I asked this question on twitter also and IRCC confirmed that I can use this. I would suggest you too confirm the same. Once you get ITA explain your situation transparently with the twitter reply in LOE. I am providing reply on my tweet.

@jassisidhu, check IRCC response on my tweet, you can caim sibling points for your blood related sibling even if sibling has been adopted by someone.You have Dob, I didn't have even DOB , so I attached DNA report from IRCC approved lab and they didn't ask any other document. I also provided all the details and link for tweet in LOE. IN your case DOB should suffice , provide all details transparently in LOE.

Tell your consultant and I am here in Canada because of these 15 points only.
