Landlord and Tenant Board - Landlord Eviction

I’ll attempt to make this as short as possible. In July of 2018, the neighbour who shares the duplex we live in assaulted me. They were charged with assault and convicted as of Jan 2019 .. the person was my landlords daughter and as soon as she was arrested I was sent a message stating I had 10 days to vacate the premises (sent by the landlord whose daughter assaulted me) now because I knew my rights I contacted the appropriate people and they sent letters and contacted the landlord to state the law. Months later (October) they served me with a legal N4 - stating, but lying of course - that they were moving their small business to this space that I currently occupy. The move out date was February 1. Well that has come and gone and I haven’t left the premises for two reasons 1. I believe I’m being evicted in bad faith (always paid rent, never late, clean tenant) and 2. There is no affordable housing as housing has skyrocketed.
I received a message this morning stating the following :An application to evict is being filed with landlord tenant board. With damages for any delay caused in the scheduled opening at the new location for the commercial tenant. Plus any award provided as compensation for staying beyond your tenancy as well as Ltb applications, legal costs and sheriffs costs.
My question is how likely are they to be awarded all of this? I contacted the city’s building and planning department who stated the very first permit they would need is a permit to convert residential to commercial which they haven’t even applied for so the fact that they are claiming compensation for delay of moving their flower shop is just insanity. The woman (the landlord) owns her own life insurance company so has plenty of money for a fancy lawyer for the hearing... does anyone have any advice for how I can avoid being pegged with all thesw additional charges other than hiring my own lawyer (which I can’t afford to do, single mother who works full time ) |
