Illegal rent increase

1) I signed a lease on a house 3+ yrs ago, and we also made an agreement. We agreed to pay a lump sum to help pay for a backyard fence. This sum was intended and stated in the contract to pay for future rent increases, meaning that once the money was gone from paying the standard yearly Ontario increase then we would start paying out of our pocket again for the full rent legitimately owed as per ontario rent increase guidlines.
We still have approximately $600 left from this agreement and now our landlord is demanding that we pay $120/month more or be evicted in 10 months (he knows he has no "cause" but will claim to move in himself in order to force us out).
Please note that none of this was given with proper notice, as a matter of fact the $120 a month increase was given with 19 days notice.
So what we need to know is...
If we agree to pay this increase would it still be considered an illegal increase?
Also if we were to pay this increase are we eligible to ask for this money back at a later date from the courts?
We still have a balance that is supposed to be paid towards the rent of almost $600, how did we get it back?
Finally, if we agree to pay this extra monthly amount, do we forfeit any future action that we can take based on the money we have lost from the previous agreement?
This will effectively reult in us paying him over $1500 more than he has the legal right to ask. |
