The quick answer to your question is:

Yes, but only if your spouse or partner has a work permit.
If your spouse applied, or wants to apply, under the Spouse or Common-Law Partner in-Canada class, he or she can apply for an open work permit.
If you live in Quebec, your spouse or partner also need to get a Québec Acceptance Certificate (CAQ) from the Quebec government.



But keep in mind:

Remember that while your spouse or partner’s permanent residence application is being processed, he or she must:
  • Maintain legal status as a visitor, student or worker in Canada, and
  • Wait for their work permit application to be approved before starting to work.

I'm sorry that I wasn't clear in the information I provided.

In relation to remaining in Canada, yes, your spouse will remain a visitor and their legal status will fall under the guidelines of a visitor's visa until they acquire a different visa/permit.

In the first link, the second blue notice relates to the open work permit. Your spouse may be interested in applying for this while applying for their PR as it may process faster than a PR application. If the applicant did not request a change of address it is unlikely IRCC would reach out to them to do so. There is a chance this is not a legitimate request from IRCC. On their website, IRCC says:


To avoid email scams, remember that IRCC NEVER:
  • emails applicants to confirm basic personal information provided on application forms.
  • asks for banking or credit card information to collect payments by email.
  • sends visas, permits, certificates or immigration documents by email.
  • offers special, time-limited promotions or cash deals to get visas, permits or citizenship status.

The first thing you should do is contact IRCC directly to understand if they sent this request.

As our website caters to newcomer in Ontario, therefore I assume that you are referring to the Ontario Immigrant Nominee Program (OINP) rather than another Provincial Nominee Programs (PNP). Different provinces have different requirements for their PNP programs.

You can find information about the OINP on Settlement.Org or on the OntarioImmigration.ca website. According to the OntarioImmigration.ca Question and Answer webpage, proof of funds refers to
money you have in your bank account(s) – in Canada or overseas
. Therefore proof from your bank account(s) in the Philippines should be sufficient.

Thank you for sharing your situation and question with us.

You can find some detailed information on what the requirements are to be eligible for this type of sponsorship are on the Immigration, Refugees and Citizenship Canada (IRCC) website in the Determine your eligibility – Sponsor your eligible relatives section.

Here is an excerpt of the requirements,

Who you can sponsor


Depending on your circumstances, there are two options for who you can sponsor.

Option 1 - Orphaned close relatives

You can sponsor close relatives, related by blood or adoption, such as brothers, sisters, nephews, nieces, or grandchildren only if they meet all of the following conditions:


-They are orphaned,
-They are under 18, and
-They do not have a spouse, common law partner, or conjugal partner.


Option 2 - Other relative

You may sponsor one relative, related by blood or adoption, of any age if you meet all of the following conditions:

-you do not have a spouse, common-law partner, or conjugal partner, or one of the following living relatives you could sponsor instead:


-son or daughter,
-parent,
-grandparent,
-brother or sister,
-uncle, aunt,
-nephew or niece.


You do not have any of the above-named relatives who is a:

- Canadian citizen,
- permanent resident, or
- registered Indian under the Indian Act.


If the relative you want to sponsor has a spouse, partner, or dependent children who will come with them to Canada you must include them on the same sponsorship application.

If your relative does not qualify for sponsorship they may still be able to come to Canada as a skilled immigrant through Express Entry. Express Entry manages applications for certain economic immigration programs and selects applicants for their skills, experience and ability to contribute to Canada’s economy. Express Entry candidates may be awarded points for having a family member living in Canada. More information is available on the Express Entry web page.



As you may have noticed, it is not easy to meet all of these requirements.


You may want to contact the Immigration, Refugees and Citizenship Canada (IRCC) Call Centre for some information and clarification as to whether or not you meet all of these requirements.

We can appreciate that you would be interested in this type of information.

Unfortunately, it is difficult for us to provide a definitive response regarding this type of situation. However, we have received some information from the Immigration, Refugees and Citizenship Canada (IRCC) Call Centre.

It is true that the Application for Canadian citizenship under subsection 5(1) – Adults 18 years of age and older (CIT 0002) Instruction Guide states,


You must provide all of these documents in your possession. If any of these documents are no longer in your possession, please explain why.



We have contacted the Immigration, Refugees and Citizenship Canada (IRCC) Call Centre and they have stated that she can apply for citizenship including an explanation why she does not have those documents as well as additionally including at the same time, an Application for a Verification of Status (VOS) or Replacement of an Immigration Document (IMM 5545).

The Immigration, Refugees and Citizenship Canada (IRCC) Call Centre representatives stressed that these applications should be submitted at the same time and in the same envelope.

It is best if you and your mother contact the Immigration, Refugees and Citizenship Canada Call Centre to speak to some Call Centre Representatives to confirm this information and to see what they recommend and what are the first steps she can take.

We have received some information from one of our researchers.

They have contacted the Immigration, Refugee and Citizenship Canada (IRCC) Call Centre for some information and suggestions.

According to the Immigration, Refugee and Citizenship Canada (IRCC) Call Centre, since the goal is to apply for citizenship, they suggested that you should apply for Proof of citizenship as well as an Application for a Search of Citizenship Records at the same time.

As you may not have a lot of information on hand, they suggested that you should try and fill out the proof of citizenship form to the best of your abilities and specify which information is not available to you at this time, as well as the reasons for which you do not know or have that information.

They also suggested that you should refer back to your application for search of citizenship records where applicable to explain any major gaps. The Immigration, Refugees and Citizenship Canada (IRCC) Call Centre representatives stressed that these applications should be submitted at the same time and in the same envelope.

By going down this process and submitting the applications for both of these at the same time, Immigration, Refugees and Citizenship Canada (IRCC) will search for relevant documentation where needed, such as the proof of pension payments or anything else that can help verify parental lineage in Canada.

Ultimately, if both documents are filled out and the documents are recoverable, the application will go through at the same time and, according to them, you should be able to proceed with obtaining citizenship.

It may also be helpful to review the checklist of items needed for proof of citizenship.

The Application for Search of Citizenship Records currently costs $75 to process. The Application for a search of citizenship records (CIT 0058) Calculating your fees section states that if you are applying for a citizenship certificate (proof of citizenship) at the same time as this application, you do not have to pay for a search of citizenship records.
