Hi, I am a PR holder so was my son. But since past 3 yrs both of us living in USA.

I renewed my PR card since fulfilled the 2 yrs requirement but my son did not. He was born in USA before we got our canadian PR card.

Now the problem is, I am planning to come back to canada since my PR card is still valid and my son can also enter Canada from his US passport and go to school since i am still PR holder.

His health card is still valid until 2017 but his PR card has expired.

So, can i still use that health card or I need to buy private health insurance for him until I sponsor him and he get his new PR card.

Hi,
Me, my husband and my son became permanent resident in Canada in 2009. We made an entry and went back to USA. After 2 yrs only I came back to Canada and stayed for 2 yrs to maintain my PR. My husband was studying in USA and my son who was born in USA was living with his grand parents in my back home country.
My son came back to Canada and stayed with me for a year and both of us went back to USA to live with my husband. I renewed my PR since I stayed for 2 yrs but my son PR renewal got rejected so was my husband. I was getting child tax benefit when my son was in Canada but when we decided to go to USA I called them to cancel his child tax benefit.
Me and my son are planning to come back to Canada again to maintain my PR (my PR card is still valid until 2019). My son can also enter Canada with his US passport.
His health card is still valid until 2017.
1. Can I apply for child tax benefit for my son even his PR card is not valid, after I file my tax? I haven't filed my tax since I left canada for 3 yrs.I am planning to do it when i get there.
2. Does he need to apply for visit visa to stay in Canada since he is not a PR holder but US citizen in every 6 months?
3. Do I need to sponsor him to become PR in Canada?
4. Can he use his health card (still valid) or he wont get his health card until I sponsor him and he gets his PR card.

Hello Jan,

Thank you for sharing your question and situation with us.

As you may know, you can be outside of Canada for 212 days in a 12-month period and still be covered by your OHIP.

In some cases, after an extended period of time, a Health Card may be cancelled.

Generally, if you move to Ontario from another country, the waiting period begins on the date you establish or re-establish residence in Ontario.

We suggest that it may be best for you to contact the nearest ServiceOntario for clarification regarding what the process is.

Thank you Anna,

Can I apply for child tax benefit for my son after I get there and file my tax even he is no longer PR holder? I haven't filed my tax since 2013. I am planning to file when I get there. Does the child has to be a PR holder to apply for child tax benefit?
Or do I need to wait until I sponsor my son for PR and after he gets his PR card I can apply for child tax benefit?
and about health card, if his still valid card doesn't work can I apply for his health card right away or I need to wait until he gets his new PR card? that means after I sponsor him.
Do I need to get a job first to sponsor my 7 yrs old son or I can sponsor him after I enter Canada?. He will be staying with me.
Last but not the least, does he need to apply for visit visa to stay in Canada (he is a US citizen) and renew every 6 months?
