Thank you for sharing your situation and question with us.

We have had several users share their experiences regarding landing and then leaving shortly after landing.

As a permanent resident, you may travel outside Canada after you arrive. However, you must meet certain residency obligations to maintain your status as a permanent resident.

To meet these residency obligations, you must be physically present in Canada for at least 730 days (2 years) in every 5-year period. The 5-year period is assessed on a rolling basis. Immigration, Refugees and Citizenship Canada (IRCC) will look back at your time in Canada over the previous 5 years.

Immigration, Refugees and Citizenship Canada (IRCC) will mail your PR Card to the Canadian address you provide, after the information and photograph on your Confirmation of Permanent Residence document is confirmed by a IRCC official when you arrive in Canada. Unfortunately, you will not receive your PR card right away.

It is important to note that you are required to have a PR card that is valid, or in other words, not expired, in order to travel back to Canada by plane, train, bus or boat.

If you are outside Canada and you do not have a valid PR card, you will need to get a permanent resident travel document (PRTD) to return to Canada.

In terms of applying for a PRTD, you can find some information regarding what the document requirements are on the Immigration, Refugees and Citizenship Canada (IRCC) website in the Applying for a Permanent Resident Travel Document (IMM 5529) application.

We have previously received some information from one of our legal researchers related to being in Canada after not meeting the residency requirements.

According to their research, the five-year time frame set out in the Refugee and Immigrant Protection Act is not static. Rather it is a moveable window that is dependent on the time at which a visa officer examines your situation. Therefore, if you cannot fulfill the two-year (730 day) requirement for the five-year time frame starting from when you became a permanent resident, you should remain in Canada until you can satisfy the requirement for another five-year time frame.

The IRCC’s Permanent Residency Status Determination Manual states:

For persons who have been permanent residents of Canada for more than five years, the only five-year period that can be considered in calculating whether an applicant has met the residency obligation is the one immediately before the application is received in the visa office. A28(2)(b)(ii) precludes a visa officer from examining any period other than the most recent five-year period immediately before the date of receipt of the application.


Since the officer cannot choose any five-year time period for consideration, but must always assess the most recent five-year time period (the one immediately preceding examination), they may still have the opportunity to satisfy the two-year “in Canada” requirement.

As you may already know, a PR card is required to re-enter Canada.

Canada’s entry requirements are changing

Permanent residents (PR) of Canada must carry and present their valid PR card or permanent resident travel document (PRTD) when boarding a flight to Canada, or travelling to Canada on any other commercial carrier. If you do not carry your PR card or PRTD, you may not be able to board your flight, train, bus or boat to Canada.

It is your responsibility to ensure that your PR card is still valid when you return from travel outside Canada, and to apply for a new PR card when your current card expires.

Returning by private vehicle

There are other documents you can use to enter the country.

When you return to Canada, apply for a PR card if you plan to travel outside Canada again.

Some examples of private vehicles include, but are not limited to: a car, truck, motorcycle, or recreational vehicle that you own, borrow, or rent, and that is not available for public use.

Returning by commercial vehicle: airplane, bus, train, or boat

You must apply for a permanent resident travel document (PRTD), valid for one entry. Otherwise you may not be able to travel to Canada.

You can apply to replace your PR card when you return to Canada.


It is important to note that if your son decides to try and get a Permanent Resident Travel Document (PRTD), they will look into whether or not he has met his residency requirements. This will start the process of reviewing whether or not he has met his residency requirements.

We suggest that it is important and probably best that you speak to a Lawyer who is familiar with Canadian immigration issues for additional information regarding you and your family's situation and before they apply for a PRTD or to renew their PR cards.

How long it will take to get my PR card, SIN and Health Insurance?


You can find timeline listings on the IRCC website, Service Canada and ServiceOntario website.

Specifically regarding the SIN, if you apply in person and everything is in order, you will get your SIN during your visit and you will not need to part with your documents.

Regarding your question,

My wife is planning to stay for extended days till we receive all the 3?


With respect to OHIP, there is a three-month waiting period for your OHIP coverage.

The waiting period begins on the date you establish residence in Ontario. You may also be required to be present in Ontario for 153 days of the first 183 days immediately following the date residence is established in Ontario (you cannot be absent for more than 30 days during the first 6 months of residence).

Regarding your question,

Will I get the child benefits and tax benefits for the first two years outside Canada?

  • will be in Ontario for at least 153 days a year in each of the two years immediately before you leave the country
Before you leave, take the following items to the nearest ServiceOntario centre to make sure your OHIP coverage stays active:
  • your health card
  • proof of residency (e.g. mortgage, lease or rental agreement, property tax bill, valid driver’s licence)

Regarding your first question,
1. I have been deemed a non-resident of Canada for tax purposes since 2016 - does this have any impact on my PR card renewal or citizenship application? I still meet the 730/1095 days requirement for the last 5 years from the date that I am applying.


In order to apply to renew your PR card, you should ensure that you have met your residency requirements before applying to renew for your PR card.

The same goes for applying for Canadian citizenship. If you have met the residency requirements, you can apply.

Regarding your second question,
2. How soon before November 2019 can I apply for a PR card renewal? I would like to apply at the same time as my citizenship application which would make it 9 months before expiry.


According to the Immigration, Refugees and Citizenship Canada (IRCC) website in the How do I renew my permanent resident card? section,

If your permanent resident (PR) card is expired or will expire in less than 9 months, you can apply for a new card. The new card will have a new expiration date. Most new PR cards are valid for 5 years.



Regarding your third question,
3. Can I apply for both the PR card and citizenship at the same time?


If you have met your residency requirements for both, you can apply for them both.

Regarding your fourth question,
4. Is a picture of my university degree (I attended a Canadian university) enough evidence to demonstrate adequate knowledge of English?

Regarding your fifth question,

5. Is it correct that I must submit my applications within 90 days from the date that I have signed ie. my date of application is February 19 and I must submit before May 19 for it to be accepted?


According to the Immigration, Refugees and Citizenship Canada (IRCC) website in the Application for Canadian citizenship under subsection 5(1) – Adults 18 years of age and older (CIT 0002),

Your application will be returned to you if it is:

dated more than 90 days before we receive it

Generally, if you are living in a subsidized unit, you must inform your housing provider about changes to your situation that might affect your rent subsidy.

You may want to try and contact a Community Legal Clinic to see if it is possible for them to provide some assistance. Please note, some Community Legal Clinics do not provide services related to subsidized housing or rent-geared to income type situations. In this case, they may be able to provide a referral or information regarding this type of situation.

You may be required to work with your housing provider directly and find out what their processes are regarding these type of situations, for example if it is possible to appeal a decision.
