1. The posted processing time is 61 days for the first PR card and 70 days for renewals: http://www.cic.gc.ca/english/information/times/index.asp So you are well within the processing times.

Hi,

I am hoping someone can give me some advice or can share a similar experience…
I arrived in Canada with PR status on 24th July 2017 and am yet to receive my PR card. I believe I have exhausted all avenues or trying to find out my info about application, I have:
Called the IRCC helpline over 100 times without being able to speak to an agent
  • Emailed the IRCC through the suggested web form without receiving anything other than automated responses 12 working days ago.
  • Sent a solemn declaration to the office in Nova Scotia, declaring a card was never received around 1 month ago.
  • Called the British consulate (I am British), who were unable to help
  • Spoken to the VAC office in London about processing a temporary travel document whilst I am in the UK. As I will only be back in UK for a few days and they need my original passport I will not be able to get it processed in time over the holiday period.
For clarification, I have not changed address since moving to Canada. I will be traveling from 21st Dec 2017 to 1st Jan 2018.
At this point I believe my only option is to travel without my PR card and present my confirmation of PR document along with evidence if being a PR of Canada (work contract, driving license, health card and tenancy agreement).
Does anyone have any advice as to:
- How likely it is that I get through immigration without my PR card?
- Anything else I can do to find out the status of my PR card?
Thanks,
Kane

1/ You can only keep calling the call centre.
2. If you try to return to Canada by air, without a PR card or PR Travel Document you will be refused boarding by the airline. Those are the only 2 acceptable documents for PRs.
3. One other choice is to fly to a US border airport and cross in a non commercial carrier, and you will be admitted with your Passport and COPR.

Can I apply for Permanent Residency in Canada?

I'm American and my wife is Canadian. I was hoping to immigrate to Canada. My wife would be sponsoring me but I was wondering if I could apply for Permanent Residency while I'm living with my wife in Canada? (I currently work in the US and live with my wife in Canada on my days off.)

I don't currently possess either a student visa or a work visa. The Canadian Immigration website doesn't really give a clear answer and I don't want to get into any trouble staying in Canada past the normal 60 days while the application is being processed.

Thanks for any help that you can give me.

1. There shouldn't be any problem with your spouse sponsoring you. It would be an outside Canada sponsorship as I assume that you intend to keep commuting. See: http://tinyurl.com/yc8dxsgq
2. Since you keep entering and leaving Canada, your visitor status ends every time you leave and recommences every time you re-enter Canada. Note that there is always the possibility that you may be denied entry, if the CBSA officer decides that you are residing in Canada.

Hello, my legal advisor is quoting 6 months processing times for H&C application. However the Government website states it's 29 months. Is it realistic to have an H&C application approved within 6 months? Thank you.

1. 6 months is not realistic, since the only program that has a 6 month processing time is Skilled Worker where 80% are processed within 6 months of the application. Count on 29 months or more.

May I use the 'Spouse or common law in Canada Class' application for my wife how is currently living in Canada with a expired visitors VISA?

I initially sent in the spousal immigration application in September 20, 2017 while my wife had a valid VISA. My application was returned in November 22, 2017 as a result of missing documents. My wife's VISA expired on September 30, 2017.

1. Yes you can, but she/he is not eligible for an Open Work Permit as s/he no longer has status.

I'm American but don't have a study or work permit.

I'd like to stay in Canada while the application is being processed if possible.

Thank you for your time.

1. Yes, see: http://www.cic.gc.ca/english/information/applications/spouse.asp

Hey curious as to weather i apply for a open work permit (international experience canda) while I wait for the PR applcation to be completed. My partner and I live in Australia now but she can't stay after Feb????

1. There is nothing stopping your from applying for an IEC open work permit if you are eligible

"

Note: As an Australian citizen, you may participate in the Working Holiday category only once. If you meet the eligibility criteria, you may participate in IEC one more time through the International Co-op (Internship) category.
Exception: If you participated in IEC one or more times before 2015, you might be eligible for a final participation of up to 24 months in the category of your choice.

To be eligible for the Working Holiday category, you must:
  • be an Australian citizen,
  • have a valid Australian passport for the duration of your stay in Canada—your work permit in Canada will not be longer than the validity of your passport,
  • be between the ages of 18 and 30 (inclusive),
  • have a minimum of CAN$2,500 to help cover your expenses in Canada,
  • have health insurance for the duration of your stay—you may have to present evidence of this insurance when you enter Canada,
  • be admissible to Canada,
  • have, before departure, a round-trip ticket or demonstrate that you will have the financial resources to purchase a departure ticket at the end of your authorized stay in Canada,
  • not be accompanied by dependents, and
  • pay the fees.

I am a new immigrant. I landed on sept 19, 2017. I was requested to send the photos for PR card on Nov 8. I sent those out on Nov 10. I have not yet recieved my PR card. I need to travel back to India on Dec 20 for my wedding. What are my options? What should I do now? I know that I need the PR card to enter Canada. I will return by Jan 18, 2018. Please guide me about what should I do ?

1. If you PR card arrives in Canada before you are ready to return (unlikely) it could be couriered to you in India. Your only other choice is to apply for a PR Travel Document in India. Posters in other forums says that it has been taking 3/4 weeks for a PRTD.

Hello,

I completed my lading in Canada last year for the first time. At that time, I prepared the accompanying goods and the goods to follow forms however they were not stamped as I was informed that I should only do that when I move permanently.

I visited Canada again this year and now I am moving permanently.

I would like to know what should be the process of moving my belongings now?

Is it still subject to duty exemption?

Thank you.

1. There are no taxes or duties on "settler's effects" although if some items are obviously newly purchased after your "landing" and the time you import the goods, there maybe taxes/duties on only those items.

Hello,

My family and I arrived in Ontario early this year with a permanent residency visa.

I've received an offer of employment to work abroad for a United Nations agency. I would like to know whether I'll be able to maintain my permanent residency status in the following two scenarios:

1) I decide to go with my family abroad for the UN job,

2) I decide to go abroad for the UN job but my family remains in Canada.

Thank you in advance for considering my query.

Best

1. Working abroad with the UN will not protect your PR status in Canada.
2. If your family remains in Canada, you could still lose your PR status if by working abroad you don't meet your residency obligations.

Travelling with a Canadian Spouse - PR Question

Hi Settlement.Org,

What a great website!

I am Canadian. My wife (British) has just received her Canadian Permanent Residency but we have had to come back to the UK, as both of our jobs in the UK have not yet expired. It will also take her some time to study for and finish the Canadian nursing exams so we can both find work in Canada.

We know that you have by physically present in Canada for 2 years every 5 years, but because 'we are outside of Canada for an extended amount of time, and travelling with a Canadian spouse' than we can accumulate residency days.

Does this mean, as we left Canada together, that every day we spend in the UK counts as 'residency days'?

Thank you for your help in the matter.

Best wishes,
Proud Canuck

1. Yes, a PR spouse accompanying his/her spouse abroad, maintains their PR status. Note the time doesn't count towards citizenship.

I have questions related to whether my family and I are required to take any english tests to prove that we can speak the language.

As well as if we have taken previous English proficiency exams such ss IELTS or similar ones do they count or is there a specific period and it expires.

Thank you

1. IELTs general doesn't expire for citizenship purposes.
2. Otherwise you will have to take either CELPIP or IELTs or you took LINC training or prove that your education abroad was in English and you need a letter from your school for that.

PR Status and Not Renewing PR card while in Canada

I read this on an Immigration Lawyer or Consultant website:

"Just because someone living in Canada has a Permanent Resident Card does not mean that he or she gets to stay indefinitely without renewing the card. "

What does that mean? If my PR card expires, I can no longer live indefinitely in Canada. Will I lose status? Is this true?

I have no response for clarification.

1. Doesn't make sense the statement from the lawyer/consultant. If you have PR status and no intention to travel, there is no requirement to have a valid PR card to remain in Canada.

Hello,

I believe this question was probably asked before however, I am reposting as I did not get a clear answer (or received a mixed answer).

I am a Canadian citizen and I want to sponsor my brother to Canada. I looked up at various resources and got yes/no/mixed responses so far and have not got a clear or precise answer to my question yet. I checked CIC website and the information seems rather confusing. Following are my circumstances:

1. I am single and never married.
2. My parents are alive and they do not live in Canada.
3. I only want to sponsor my brother to Canada.
4. I AM THE ONLY ONE IN CANADA. I do not have any family members (blood relation) in Canada.
5. My brother is 28 years old.

I am aware there are another options such as Express entry or Skilled workers but I believe he might have better chances to immigrate to Canada if I sponsor him rather than him applying independently.

Thank you.

1. No, you can't sponsor your brother as your parents are alive. Whether they wish to come to Canada or not is immaterial.

I would appreciate it if you could point out in the correct to have any update regarding my application.
