My husband is a PR in Manitoba.
My husband has declared bankrupcty and will be only be cleared by April of 2017.
Can he still file for spousal sponsorhip with his current status?
Due to a health situation I need to join him as soon as possible.
Kindly advice what's the best action on this. Thank you in advance. Any helpful info will be greatly appreciated
1. No, he can't sponsor if he is an undischarged bankrupt. 2. If you can get a visitor visa (TRV) if you are from a non visitor visa exempt country, then you could visit. Maybe difficult with a spouse in Canada. |

When does the 5-year period begin?

I renewed my Permanent Resident Card in December 2015. know I have to be at least 2 years in a period of 5 years to keep my residence. My question is:
Does this 5 year period begin to be counted since the moment I got my new PR card by renewal or I still have to count the days in or out before getting my new PR Card?
1. No, it is a rolling 5 year period. IRCC looks back and forward to determine if you meet the residency obligations. For example from todays date, 22/08/16, they look back to 23/08/11 and you would have to have 730 days of residency in Canada. Next August they would look back to August of 2012 to determine the number of days residence. The date on your PR card doesn't really enter into the equation. For new PRs they look forward from the date of landing, to determine if you would be able to reside in Canada for 730 days from the date of your first "landing" |

I have send out my renewed PR Card application by the regular mail at July 13, 2016. But I have not get any reply from CIC until right now yet. Is it a common situation or not? How can I check that is it going on the right way or not?
With Best Regards Hiroshi Moji
1. The processing time for renewals is 91 days, you won't hear anything from IRCC unless there is a problem. |

Eligible to sponsor Mother IF received EI?

Hi everybody,
I am planning to sponsor my mom. I read this on the office website: ( the underlined part plz)
- You may not be eligible to sponsor your parent or grandparent if you:
- failed to provide the financial support you agreed to when you signed a sponsorship agreement to sponsor another relative in the past
- defaulted on a court-ordered support order, such as alimony or child support
- received government financial assistance for reasons other than a disability
- were convicted of a violent criminal offence, any offence against a relative or any sexual offence—depending on circumstances, such as the nature of the offence, how long ago it occurred and whether a record suspension (formerly called “pardons” in Canada), was issued
I used to get EI in 2012. Am I eligable to sponsor my mom in 2017?
Thanks a lot for your help..
1. EI is not public assistance, it is an insurance scheme where you pay when you are working and collect when you are not working. It has no effect on sponsorship. |

Hello, I landed in 2011 in Canada but still have money parked back home since those were term deposits and am hoping to transfer 100,000 CAD to Canada.Would I have to inform CRA ? Are there any taxation implications?? Thanks.
1. No, the bank receiving the funds has to report it to Fintrac. 2. There are no tax implications, unless you have not reported the income generated on your tax return since you became a PR. 3. If you had over $100K invested overseas, it should have been reported on your income tax. |

1. If you are not reported on entry for not meeting your PR obligations, you should not submit a sponsorship until you meet those obligations. |

1. You can't sponsor your daughter as you didn't declare her when you applied or when you "landed". So she is not a member of the family class. She can only submit an application under Humanitarian and Compassionate grounds under section 25(1). You would support the application. It doesn't matter that you didn't know that you had a dependent, she was still not declared. |

Hi, My husband received the Confirmation of Permanent Residence but has a condition 51 stating that we have to cohabit in a conjugal relationship for 2 years. This is totally fine, but he will need to travel abroad within that period for family functions (sisters wedding, brothers graduation etc.) and for work settlements. Will he have an issue when he re-enters Canada? Appreciate your advice.
1. No, he shouldn't as long as you are living together and if he travels alone, it isn't for a long period of time, such as months. |

Hi.Thank you thay you have considered my question and reply me.Actually my son is facing problem in school regarding his name one letter is missing.Actually school managment wants proof that this is not a mistake and in your records his name has fully printed, but on pr card one letter is missing due to limitation of space. They write his name just as written on pr card.can you please send me any letter or proof which i can show to school and they write his full name as it has been pronounced.i can send you his pr card number and full name.Thank you.
1. Here is what CIC says
What should I do if my new permanent resident card has a mistake or something is missing? If we made the mistake, you can apply for a reissued permanent resident (PR) card. If either your given name or your surname has more than 28 letters, the name appearing on the PR card will be shortened. This is not a mistake and the card will not be reissued to change the name. For cards issued before November 21, 2015, names are limited to: - first name: 15 letters or less
- last name: 20 letters or less
For cards issued on or after November 21, 2015, names are limited to: - first name: 28 letters or less
- last name: 28 letters or less
If your son's situation doesn't fit into the above, get an amended PR Card |

Hello everybody, I am Reza. we have got our PR card (me, my wife and my first child) lest year. Afterwards we left Canada and comeback to Iran for unfinished business. In Iran my 2nd child (my son) was born. I wanted to apply permanent residency for him through sponsorship. However in the application form it is mentioned that I am not eligible for sponsorship application since I am outside of Canada. Does anybody has got same issue to advice me what to do? Our planning is to move permanently to Canada middle of next year, that is why I want to begin the procedure of PR card for me son now. thanks for your kind advice.
1. As PRs to sponsor, one of you has to be residing in Canada. 2. You can apply for a TRV for the child and if that is refused, then you can apply for a TRP (Temporary Resident Permit), either would allow you to travel to Canada, with the child and then commence and overseas sponsorship (Which would probably be processed in Ottawa) 3. if you don't get a TRV or TRP, then one of the parents is going to have to return to Canada. |
