Married in Canada...Divorce Help
Moderator

Hello,
Thank you for sharing your situation and question with us.
According to the Department of Justice website in the "How to Apply for a Divorce" section,
As a general rule, only Canadian residents can divorce in Canada. If neither you nor your spouse lives in Canada, you cannot get a divorce under Canada's Divorce Act. But you may be able to end your marriage under the Civil Marriage Act if you meet BOTH of the following criteria:
-You married in Canada; and -You cannot undo your marriage in the country where you or your spouse lives because that country does not recognize your Canadian marriage. To undo your marriage under the Civil Marriage Act, you would need to apply to a Superior Court in the province or territory where you married. A lawyer in that province or territory may be able to advise you on what you need to do. You may also be able to get information from a Superior Court or from the Department of Justice or Attorney General in the applicable province. A process under the Civil Marriages Act only ends the marriage. You would need to resolve other issues such as child support and spousal support under the laws of the country where you live.
If you were referring to starting the process in California, you will have to find a qualified lawyer who is very familiar with the process. Unfortunately, we are not familiar with the process in California.
According to the California Courts - The Judicial Branch of California website,
The family law facilitator or self-help center in your court may be able to help you with the divorce or legal separation process and help you understand what your options are, decide what you want to do, and get started with your paperwork.
Contacting a Family Law Facilitator or Self-Help Center may be an option for you in terms of finding out what the process is and if you are eligible.
I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

How can I Find/Get a Start-Up or Survival Job?
Moderator

Hello,
Thank you for sharing your situation and question with us.
It is great that you are looking into this type of information before you arrive in March.
From what we have heard from many of our users, a lot of times a first job in Ontario or anywhere in Canada may be a survival job, like you have mentioned, something just to pay the bills.
There are some "typical" survival jobs. Some jobs that are considered survival jobs are, cashiers, customer service representatives, factory workers, or taxi drivers.
Some may wish to take a survival job because they can get some Canadian work experience and build a network related to their profession or trade. The amount of money that you can earn in these survival jobs can vary. You may want to look at some examples in the Job Bank . This tool was previously referred to as the "Working in Canada" tool. You can find some helpful information in our Settlement.Org How can I compare the cost of living AND salaries between my country of origin and Canada? article.
It is important that you connect with the nearest employment service as soon as you arrive. You can find some helpful information in this Settlement.Org Where can I find job skills training programs? article.
I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

How can I bring my child to Canada? - Surrogacy
Moderator
|
Hello,
Thanks for sharing your situation and question with us.
According to the OP2 Processing Members of the Family Class states regarding Surrogation:
Section 5.14:
In Canadian Family Law, the spouse or common-law partner of the parent who gives birth to a child is presumed to be the other legal parent even if there is no genetic relationship to the child. If the child was born through a surrogacy arrangement, however, the child will legally be the child of the surrogate mother who gave birth until a subsequent adoption occurs that would create a legal parent/child relationship.
In these cases, documents suitable for establishing parent/child relationships are birth certificates or authorized evidence indicating that the person claiming to be the parent is the birth mother or the spouse or common-law partner of the birth mother at the time of birth. Evidence must also indicate that the parents availed themselves of assisted human reproductive technologies and that the child was subsequently born to the mother.
Once a legal parent/child relationship is created, general rules apply.
We suggest that you contact the Citizenship and Immigration Canada (CIC) Call Centre directly for some specific information regarding your situation.
We also strongly suggest that you contact the nearest lawyer who is familiar with Canadian immigration issues for some additional information and assistance with your situation.
I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.
