Post Grad. Work Permit and Extending study permit

Moderator
Moderator
Hi there,

Thank you for your message.

Generally, to study in Canada you need a study permit. However, there are some exceptions. One of the main exceptions is for courses that last six months or less. The following is from the Citizenship and Immigration Canada website(CIC):
If you wish to study in a short-term course or program
You do not need a study permit if you plan to take a course or program in Canada that lasts six months or less. You must complete the course or program within the period authorized for your stay in Canada.

You can find out more about study permits in the Settlement.Org article Do I need a study permit? How do I apply?

You may also want to call the Citizenship and Immigration Canada (CIC) Call Centre for follow-up advice specific to your situation.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Can I Get EI if I'm Not a Permanent Resident Yet?

Moderator

Hi there,

Thank you for your message.

Eligibility requirements for Employment Insurance do not depend on being a permanent resident. You must meet the same eligibility requirements as Canadian workers. The number of hours you have to work to be eligible for EI depends on where you live in Ontario. You can look up the hours you have to work on the Employment and Social Development Canada website using your postal code.

You can also find more information on EI in Settlement.Org’s articles Am I eligible for Employment Insurance (EI)? And How do I apply for Employment Insurance?

Because you are being sponsored by your common-law partner rather than as a principal applicant, your employment and income should not affect your PR application. You may want to contact the Citizenship and Immigration Canada (CIC) Call Centre directly for some suggestions and information regarding your situation.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Can my landlord increase the cost of laundry?

Hi Taran,

Thanks for sharing your question and situation with us. We can appreciate that this is a frustrating situation.

From my understanding, you are renting a unit in a larger complex, and your landlord has increased the cost of the laundry machines without giving any notice.

According to the Landlord and Tenant Board representative we spoke with, the short answer to your question is no, they are not actually required to notify tenants in advance, though they generally should as a courtesy for good tenant relations, but they don't have to.

You may find our article What can I do if the place I rent needs repairs? for some tips for ongoing issues with your landlord. Here is an excerpt:

Your landlord is responsible for repairs in all types of rental housing. This includes repairs to heating, plumbing, electricity and appliances that come with the apartment (for example stoves, refrigerators). If you or your guests cause damage to the unit or building, you are responsible for repairing it.

This includes the laundry room and the washers & dryers.

You may wish to contact the Landlord and Tenant Board to confrim this information and to ask more question about your personal situation.

The information provided above is not legal advice. If you want legal advice please consult a community legal clinic or a lawyer about your particular situation.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Sponsoring a Spouse - Questions About Residency

Moderator

Hi there,

Thank you for sharing your situation and question with us.

As you mentioned sponsors must sign an undertaking promising to provide for the basic requirements of

the person being sponsored and, if applicable, their dependent children.

However, to sponsor a spouse, common-law partner or conjugal partner, the sponsor does not have to

meet a minimum income requirement. Nonetheless, the sponsor cannot be receiving social assistance

or be an undeclared bankrupt. You may also need to address in your application how your spouse will be

able to be supported. If your partner has children, the situation is different.

You can find information on eligibility in our Settlement.Org How do I

sponsor a spouse, common-law or conjugal partner, or dependent child living outside of Canada?

article.

You may also want to call the Citizenship and

Immigration Canada (CIC)
Call Centre for information specific to your situation.

I hope this information is helpful. Please let us know if you have further questions and if there is any

follow up to your question/situation.

Dutch Citizen to Marry a Canadian - Questions

Moderator

Hello Dutch,

Thank you for sharing your situation and additional question with us.

Unfortunately, it is difficult for us to provide a definitive response regarding your situation.

As you know, when wanting to visit Canada, there are no guarantees that you will be allowed entry. So mentioning that you are married to someone in Canada may or may not affect your entry. All we can say is that when questioned by an immigration officer, it is important to always tell the truth.

You mentioned you are from the Netherlands. Although you do not require a visa to enter, according to the CIC Website ,while you may not need a visa to visit or transit Canada, you still need to show an immigration officer that you satisfy all other requirements to enter Canada.

They are as follows:

To visit Canada, you must:

-have a valid travel document, such as a passport,
-be in good health,
-convince an immigration officer that you have ties—such as a job, home, financial assets or family—that will take you back to your home country,
-convince an immigration officer that you will leave Canada at the end of your visit, and
-have enough money for your stay. (The amount of money you will need can vary. it depends on things like how long you will stay, and whether you will stay in a hotel or with friends or relatives.)

As per the requirements above, you can see that it will be important for you to convince an immigration officer that you will leave Canada at the end of your visit.

We suggest that it may be most helpful for your spouse to contact the Citizenship and Immigration Canada (CIC) Call Centre for some additional information before you decide to visit.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Surname Change on PR card

Moderator
Moderator
Hello,

Thank you for sharing your situation and question with us.

You can find some detailed information on the CIC Website in the FAQ - I legally changed my name. What do I have to do to change the name on my PR card? section.

Here is an excerpt,

If you legally changed your name and you want your new name to be on your PR card, you must send an Application for a Permanent Resident Card to the mailing address at the bottom of the application form. Make sure to include the documents required to support your name change, which are listed in the Application for a Permanent Resident Instruction Guide.

Regarding the documentation required, the Application for a Permanent Resident Instruction Guide states,

Legal change of name

If your present name is different from the name printed on your Record of Landing (IMM 1000) or Confirmation of Permanent Residence (IMM 5292 or IMM 5688), you must send in supporting legal documentation as proof of your name change in addition to supporting identity documents as requested in section 3 of Step 1. Supporting legal documentation may include:

-a copy of a legal change of name document, court order, adoption order issued by a civil authority in a province or territory of Canada, or a marriage certificate, divorce decree, registration, declaration of union, revocation of declaration or annulment of union issued by a civil authority in a province or territory of Canada, showing your new name, unless you have been married in and are currently a resident of Quebec;

-if you are a permanent resident who changed their name outside of Canada, provide a foreign passport or other national authoritative document that has been amended to reflect the new name, and an official document linking the old and new names.

If the change of name was already approved in a previous permanent resident card application, include a photocopy of your last permanent resident card.

Important information: If you have had a legal name change, you must include a copy of your Record of Landing (IMM 1000) or Confirmation of Permanent Residence (IMM 5292 or IMM 5688) with this application.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.
