Travelling to Canada in absence of PR Card

Regarding your first question,

1. If i need to travel back to Canada i have to prepare Travel Documents; but why in the travel document it is mentioned to declare your current salary outside of Canada.


According to the Document Checklist and the Applying for a travel document (permanent resident abroad) (IMM 5529) guide with respect to employment outside Canada it requires you to provide the following,

Employment outside Canada

You may count each day you were employed outside Canada if your employment meets the following requirements:

-you are an employee of, or under contract to, a Canadian business or the public service of Canada or of a province or territory and
-as a term of your employment or contract, you are assigned on a full-time basis to:

a position outside Canada
an affiliated enterprise outside Canada or
a client of the Canadian business or the public service outside Canada

Supporting documents:

You must provide a letter signed by an official of the business stating:

-the position and title of the signing official
-the nature of the business and how it fits the description of a Canadian business (see definition above)
-details of your assignment or contract outside Canada such as duration of the assignment; confirmation that you are a full-time employee of the “Canadian business” working abroad on a full-time basis as a term of your employment, or that you are on contract working on a full-time basis abroad as a term of your contract; and a description or copy of the position profile regarding the assignment or contract abroad
-confirmation that the business was not created primarily for the purpose of allowing -you to satisfy your residency obligation

You may also include:

-articles of incorporation and business licences
-partnership agreements or corporate annual reports
-corporate Canadian Income Tax Notices of Assessment or financial statements
-copies of the Employee Assignment Agreement or Contract
-copies of any agreements between the Canadian business and the business or client outside Canada concerning your assignment to that client or business
-Pay Statements
-Canadian Income Tax Notice of Assessment
-T4 slips
-Any other evidence that you want to have considered


Regarding your second question,

2. How long does it usually take for the Travel Document after submission to Canadian consulate


You will need to contact the nearest Canadian Visa Office directly to find out the processing time.

Regarding your third question,

2. Secondly on which CIC Contact nos i can enquire about my PR card status from outside of Canada


We have had some of our users previously state that they have been able to contact CIC from abroad by dialing 1 613 944 4000. Listen to the options to get to CIC. Then you should be transferred to the CIC Call Centre.

Please note though that some have reported that it did not work for them or that it is no longer working.

You may want to give it a try.

Long distance charges will apply.

Thank you for sharing your additional question with us.

You are right that as a Permanent Resident you cannot sponsor your family from outside Canada.

You will have to return to Canada in order to do so.

As you mentioned your PR card is expired, in order to return to Canada you will have to apply to renew your PR card. However, there are some issues related to applying for PR card renewal from outside Canada that you should be aware of.

You can find some information related to this in this CIC ENF 27 Permanent Resident Card Operations Manual. Here is an excerpt,

All permanent residents who wish to obtain another PR card for reasons related to loss, theft, mutilation or expiry, must also apply using the same process. This requirement also affects anyone who did not provide the required information within the specified time frame after obtaining permanent residence status (see section 5.3 below). Persons applying for a PR card should be guided by instructions in the kit designed for this purpose, Applying for a permanent resident card (PR card) [IMM 5445E], available through the Call Centre or the Internet, in order to complete the Application for a Permanent Resident Card [IMM 5444E].

R56(2) states clearly that a PR card application must be made in Canada. Furthermore, the card must be delivered in person to each applicant, pursuant to R58(3), and be picked up within 180 days of the person receiving notification that it is ready for collection.

This enhances the integrity of the application process, allowing the local office to contact the client to review documentation and assess residency issues in person. However, it is recognized that the Regulations do not specify physical presence in Canada for purposes of filing a PR card application. Applications cannot be refused solely on the basis of evidence that the applicant was not in Canada when the application was filed. However, applicants are expected to provide an address in Canada where they may be contacted to provide additional information or to present themselves in person for the purposes of reviewing either identification or eligibility for the PR card. The CPC may refer a case to a local CIC if all or part of the application originated from outside Canada, and if there are questions as to the client’s identity, status or residency history, or the authenticity of the documentation. Clients must report in person to pick up their card in Canada, in accordance with R58(3).

Regarding your first question,

1. Can I start a new process without renouncing or renewing my PR card?


You cannot start a new process such as Express Entry because as stated above, it has not been determined yet that you have lost your permanent residency.

It is important to note that a permanent resident does not lose their status under A46(1)(b) until there is a final determination of the decision made outside Canada that they have failed to comply with the residency obligation under A28.

Permanent residents are not finally determined to have lost their permanent resident status until the right of appeal has been exhausted.


Regarding your second question,


2. Does the officer, even knowing that I have not met the residency requirements may approve my application for PR renovation? (I don't think that the immigration officer will accept my reasons - my family and my job - )


Unfortunately, it is not possible to provide you a definitive response regarding your question.

We strongly suggest that it may be helpful for you to contact a lawyer who is familiar with Canadian immigration issues for some additional information and assistance with your situation.

No Birth Certificate

According to a CIC representative, in this case, you can write a letter of explanation stating why her birth certificate has not been included in the application.

There are no guarantees however that the application will not processed without the birth certificate.

We suggest that once you arrive and start the application process that you the Citizenship and Immigration Canada (CIC) Call Centre directly.

In secondary school, students usually take an assessment so that they can be placed in the right grade.

Generally, secondary school students who have recently arrived from other countries may have an initial assessment before they can enter a school.

The changes to the Canadian Citizenship Act, which were announced last year, came into effect June 11, 2015. You can find information about these changes on the Citizenship and Immigration Canada (CIC) website.

Some of the changes include:

*Residency requirements have increased to 1,460 days (4 years) within the 6 years before applying for citizenship.
*You must live in Canada for at least 183 days per year, in each of the 4 years before you apply.
*If you are between the ages of 14 to 64 must meet language requirements and pass the citizenship test.
*You must provide evidence that you filed your Canadian income taxes.
*You will need to declare that you intend to live in Canada once you become a citizen.
*Only lawyers, notaries and Immigration Consultants of Canada Regulatory Council (ICCRC) members can represent or give advice to citizenship applicants.
