Can I travel as a PR? Former Refugee Claimant

Moderator
Moderator
Hello UI,

Thank you for sharing your situation and question with us.

Regarding your first question,

First thing I would like to know is how long does it take to get the PR card after this?

You can find the processing times listed on the CIC Website.

It currently states that it is taking 80 calendar days.

Regarding your additional questions,

Secondly my mother still resides in the country of origin and she is having serious health conditions since a year and half so I would like to know as a former refugee claimant and now PR can I visit the country of persecution for couple of weeks just to see her?

Can I use the passport of the country of persecution to travel in general?

If I do go, what could be the consequences? can I loose my status?

It is important that you read this How can a refugee lose their status in Canada? document from Your Legal Rights.ca.

Here is an excerpt,

In some cases, cessation can lead to a refugee also losing their permanent resident status.

Even permanent residents who have lived in Canada for many years could be forced to leave.

One of the reasons that a refugee can lose their permanent resident status is if they voluntarily go back under the protection of their "country of nationality". This is the country they were a citizen of when they fled.

Going back under the protection of the country of nationality is called "re-availment".

The Minister may apply for cessation based on this reason if a protected person has:

-travelled to their country of nationality
-applied for or renewed a passport issued by that country

It is important that you get some legal advice in your situation.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Moving to Toronto for Work and Wife is Pregnant

Hello,

You are very welcome.

Thank you for sharing your additional questions with us.

In terms of costs for pregnancy and delivery when you do not have OHIP, our Settlement.Org I am pregnant and don't have OHIP. What health care can I get? article states:

Having a baby without OHIP coverage can be a very expensive and stressful experience. If you do not have OHIP or other insurance coverage, hospitals can charge you what they want, including amounts above OHIP prices.

The hospital may ask for your financial information or how much money you have and set their fees based on that information. It is impossible to say definitively how much pregnancy services without OHIP will cost, as hospitals assess each case differently.

If you have private health insurance, your insurance company may pay for some of the costs. However, some insurance policies do not cover pregnancy-related costs.

In terms of additional information regarding costs, you may also wish to read similar threads in our forum, such as:
Giving Birth in Ontario: How much does it cost?

OHIP Coverage; about to arrive and pregnant

In terms of recommending hospitals, unfortunately, we are unable to do that.

However, you mentioned that you will be near Markham, Ontario. You may want to look into or contact the nearest one.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Hello,

Thank you for sharing your question with us.

Regarding your question about your residency requirements, regardless of where you live in Canada, your residency requirements are the same. To meet these residency obligations, you must be physically present in Canada for at least 730 days (2 years) in every 5-year period. There is no change that needs to be made to your PR card.

Regarding your driver's license, you can find some detailed information in our Settlement.Org I have a driver's licence from another province in Canada. How do I get an Ontario driver's licence? article.

Regarding your SIN, there is no change that needs to be made.

Regarding your health card, it may be helpful to know though that your valid health card from your former province will continue give you health insurance coverage based on that province's plan during this three-month waiting period.

According to the Ministry of Health and Long-Term Care website,

b) If you move to Ontario from another province or territory where you had provincial/territorial health insurance coverage:

If you move to Ontario directly from another province and apply for coverage, your OHIP coverage will begin on the first day of the third month after establishing residence in Ontario, provided you were insured in your previous province or territory.

Your valid health card from your former province will continue to provide you with health insurance coverage in accordance with that province/territory's plan during the waiting period.

You can find some information on what you will need to apply for OHIP in our Settlement.Org How do I apply for a Health Card (OHIP)? article.

If you have any questions you may want to contact the ServiceOntario Infoline at:

1-866-532-3161 (Toll-free in Ontario only)
TTY 1-800-387-5559.
In Toronto, TTY 416-327-4282
Hours of operation : 8:30am - 5:00pm

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Filling B4 Form after Landing

Moderator

Hello,

Thanks for sharing your situation and questions with us.

According to some Border Information Services (BIS) representatives, it is possible that due to the length of time since landing, the exemption on taxes may have been forfeited. If the officer is not satisfied or convinced that it was to have originally been included on a Goods to Follow list, then you may be subject to the tax and duty.

In the event that you have to pay, you will have to pay 13% tax on the used value of the items. They stated that when allocated a used value to your items, you may want to think of it in terms of how much you would be able to sell it for at a garage sale. That is the amount you should allocate to your used items.

An additional 9.5% duty on the used value of any furniture. The amount of duty on other items such as used clothing and textiles can vary depending on where they are made. The duty can be from 0 to 20% of the used value.

They stated that if you are interested in how much duty will be charged on each other used item, you can contact them for specifics.

It is important to note that if you are trying to bring in a used mattress, you will need to have proof/certification of a fumigation. If not, it is best to just leave it behind.

You may want to contact a Border Information Services (BIS) representative directly for some information on your specific situation.

You can contact them at:

1-800-461-9999

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Guarantor on a Rental Agreement

Moderator
Moderator
Hello,

Thank you for sharing your situation and question with us.

This is a very interesting question.

Your listing shows that the landlord is requesting a copy of your SIN.

Regarding tenants themselves, many people think that a SIN is necessary for the process of renting, however, Equifax, a Canadian Credit Bureau, this is not true. A landlord can check your credit history with your full name, current address and birth date (if you are willing to give them that information).

This means that it is optional to give out your SIN for credit purposes.

You can find some additional information in our Settlement.Org What kind of questions can a landlord ask? article.

You can also find some additional information regarding who can request your SIN on the Privacy Commissioner of Canada website.

In terms of the letter of employment and SIN request for a guarantor, you may want to contact the nearest Community Legal Clinic for some assistance.

You may also want to try and contact the Landlord and Tenant Board for some additional information.

You can find some contact information here:

Toll free: 1-888-332-3234
Toronto area: 416-645-8080
TTY: Call the Bell Relay Service at 1-800-268-9242

According to the Landlord and Tenant Board website, the service is available Monday to Friday from 8:30 a.m. to 5:00 p.m.

Wait times are highest on Mondays and the first business day of the month.

It is important to know that customer service officers can provide you with information about the Residential Tenancies Act but they cannot provide legal advice. That is why it may be helpful to contact the nearest Community Legal Clinic.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.
