University Fees - What are our Options?

Hello,

Thank you for sharing your son's situation and question with us.

According to the Immigration, Refugees and Citizenship Canada website in the Temporary resident permits: Work and study permits section,

A temporary resident permit (TRP) does not exempt the TRP holder or their family members from the requirement to apply for work and study permits.

Unfortunately, if someone is studying in Canada using a study permit (for example, foreign students), they are not eligible for OSAP. However, they may be eligible for financial assistance from their college or university.

You can find some detailed information in our Settlement.Org Who is eligible for the Ontario Student Assistance Program (OSAP)? article.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Hello,

Thank you for sharing your situation and question with us.

We can appreciate that you would be interested in this type of information.

In terms of how long or when he must enter Canada, he must land in Canada before the expiry date, which will appear on the Canadian Immigration Visa.

Yes, it is true that it is usually one year from the time medicals were completed, but as you know, it may not always be the case.

Therefore, it is very important that once the visa is issued that he confirm the expiry date on the visa.

It is best that before you agree to or sign anything that you contact the nearest Community Legal Clinic for some assistance.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

New Landlord for My Place of Business

Hello,

Thank you for sharing your situation and question with us.

It is important that you review and understand your business lease.

You can find some information regarding business or commercial leases on the Canada Business Ontario website in the Understanding your business lease section.

Rent increases

In the past, the increasing cost of operating a building was covered by an increase in rent when the lease was renewed or when a new lease was created for a new tenant. Most landlords protect themselves from unpredictable changes in real estate by including an escalation clause in a lease agreement. The clause allows a landlord to raise rent if the cost of maintaining or operating the property increases. Most landlords will negotiate the escalation clause with you.

Some examples of escalation clauses include:

  • Regular increases in rent over the course of the lease
  • Pro-rated increases in taxes, heat, maintenance and other direct costs
  • Automatically raising the rent according to the Consumer Price Index (CPI) or some comparable index of inflation
Note: The CPI generally overstates the impact of inflation, so you should not agree to pay more than a portion of the annual CPI increase, especially if the lease already contains increases for taxes and direct operating costs.

and

Commercial rents are generally measured by the cost per square foot of the space. Many landlords charge tenants separately for heat and electricity. There are at least five common ways to calculate rent, including:

[...]
  • Net-net-net or "triple net" leases
Triple leases pass on all the costs of operating the building, including repairs and maintenance to you as the renter. These types of leases are usually used for industrial properties.

When you sign a lease, it is important to realize that you are entering into a legal contract.

If you have any concerns or issues with your lease, you may want to consider obtaining legal advice.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Hello,

Thank you for sharing your situation and questions with us.

Regarding your question,

Do they refuse if i apply with the lost pr card copy?

You may want to take a look at the Document Checklist to see what your options are in this case.

How much will be the application fee for both spouse and dependent child?

You can find detailed information regarding the fees on the Immigration, Refugees and Citizenship Canada website.

You may also want to contact the Immigration, Refugees and Citizenship Canada Call Centre directly for information.

Regarding your question,

How can i show my proof of funds?

To sponsor a spouse and dependent child you do not have to show "Proof of Funds"

When you agree to be a sponsor, you must sign a contract called an undertaking with the Minister of Citizenship and Immigration (or with the Ministère de l’Immigration, de la Diversité et de l’Inclusion [MIDI] if you live in Québec).

The undertaking is a promise to provide financial support for your spouse or common-law partner’s basic requirements and those of his or her dependent children.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Hello,

Thank you for sharing your situation and question with us.

We can appreciate that you would be interested in this type of information.

You can find some detailed information on the Immigration, Refugees and Citizenship Canada (IRCC) website in the Permanent resident travel document section.

Here is an excerpt,

You can apply for a permanent resident travel document if you:

  • are a permanent resident,
  • do not have a valid PR card showing your PR status,
  • are outside Canada, and
  • will return to Canada by airplane, boat, train or bus.

and additionally in the Applying for a travel document (permanent resident abroad) (IMM 5529) section,

This application is for permanent residents outside Canada who do not have a valid permanent resident card to return to Canada. Travel documents are issued to permanent residents abroad to provide proof to a transportation company that the holder is entitled to re-enter Canada as a permanent resident.

Note to holders of a:

  • Record of Landing (IMM 1000)
  • Confirmation of Permanent Residence (IMM 5292 or IMM 5688)

These documents are not valid for travel to Canada. You must have a permanent resident card or a travel document to re-enter Canada by train, plane, boat or bus.

Who should not apply for a travel document?

You can find some information on the IRCC website in the I am outside of Canada and do not have a PR card. How can I return to Canada? section.

Here is an excerpt,

I am outside of Canada and do not have a PR card. How can I return to Canada?

Canada’s entry requirements are changing

Permanent residents (PR) of Canada must carry and present their valid PR card or permanent resident travel document (PRTD) when boarding a flight to Canada, or travelling to Canada on any other commercial carrier. If you do not carry your PR card or PRTD, you may not be able to board your flight, train, bus or boat to Canada.

It is your responsibility to ensure that your PR card is still valid when you return from travel outside Canada, and to apply for a new PR card when your current card expires.

Returning by private vehicle

There are other documents you can use to enter the country.

When you return to Canada, apply for a PR card if you plan to travel outside Canada again.

Some examples of private vehicles include, but are not limited to: a car, truck, motorcycle, or recreational vehicle that you own, borrow, or rent, and that is not available for public use.

Returning by commercial vehicle: airplane, bus, train, or boat

You must apply for a permanent resident travel document (PRTD), valid for one entry. Otherwise you may not be able to travel to Canada.

You can apply to replace your PR card when you return to Canada.

You may also want to contact the IRCC Call Centre directly for some information regarding what your options may be.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Eligible for E.I. if relocating for Spouse's Job?

Hello,

Thank you for sharing your situation and question with us.

We can appreciate that you would be concerned about this situation.

You can find some detailed information in this Community Advocacy & Legal Centre (CALC) - I need to move with my spouse or child: Can I get Employment Insurance benefits? document.

Here is an excerpt,

I need to move with my spouse or child: Can I get Employment Insurance benefits?

Even though you would usually be refused Employment Insurance (EI) benefits if you quit your job, there are exceptions to this rule. For example, if you quit your job because your spouse or child needs to move and you need to move with him or her you might still get EI benefits.

When you apply for EI benefits with a Record of Employment which shows that you quit your job, you will most likely be contacted by a member of Service Canada. You will have to show a few things to prove that you had just cause for quitting.

First, you must show that your spouse, common law partner or dependent child had to move to another residence (such as anew city or province).

Under the Employment Insurance Act a “common law”partner is someone you have lived with in a conjugal relationship for at least one full year. In special circumstances, you could be considered common law partners even if you have not lived together for a full year; for example, if you and your partner are expecting a baby, you have adopted a child or you are getting married in the near future.

Second, you must show that you had no reasonable alternative to leaving your job. This might include situations where it would simply be too expensive for you and your partner to live in separate residences or where it is impossible for you to keep your old job by commuting to work or transferring to another position within your company.

Third, you must continue to show that at your new location, you are ready, willing, and able to work at all times. You will have to look for work at the new location and keep a written record of the employers you contact and when you contacted them.

If you leave your job because you prefer to move with your spouse or common-law partner when there are other reasonable alternatives or ways for you to stay at your job, it will be difficult to show that you had just cause for quitting.

Every situation is different and the person who will decide whether you are eligible for EI benefits will look at all of your personal circumstances before making a decision. It is important that you get legal advice before you quit your job for any reason.

If you are refused EI benefits, you can appeal the decision. Call the clinic for help.

You can find some additional information on the Service Canada website in the Employment Insurance (EI) and voluntarily leaving - A number of circumstances for quitting are considered just cause section.

Here is an excerpt,

You are justified voluntarily leaving your job in the following situations if, considering all the circumstances, quitting your job was the only reasonable alternative in your case:
[...]

Hello,

We can appreciate that you would be interested in this type of information.

You can find some detailed information in our Settlement.Org I have a driver's licence from another country. How do I get an Ontario driver's licence? article.

Here is an excerpt,

You may be able to exchange it for an Ontario driver's licence. The type of licence you can get depends on how much driving experience you have and if the country has a reciprocal agreement with Ontario.

and

Countries With a Reciprocal Agreement

Some countries, like the United States, Australia, France and Korea, have an agreement with Ontario which allows licensed drivers to obtain an Ontario licence without having to go through the regular process for obtaining a licence in this province.

If you have a driver's licence from one of these jurisdictions with Licence Exchange Agreement, you can benefit from this privilege.

The type of licence you can get depends on how much driving experience you have. You follow the same process as drivers with a licence from another Canadian province and from Canadian Forces - Europe.

Read about the Licence Exchange program on the DriveTest website to learn more about the process and the documents required.

New Immigrants PR process time & travel plans

Moderator

Hello,

Thank you for sharing your situation and question with us.

We can appreciate that you would be interested in this type of information.

Regarding your questions,

1. I m planning a 15 to 20 day trip to Canada. Is it possible to receive your PR card post arrival in this time?

2. Post landing in Canada, Is there a way i can ensure that PR card is issued to us in 15-20 days time? If yes then what is the process and what are the requirements for the same.

All newly arriving immigrants will receive the PR Card as part of the immigration process.Citizenship and Immigration Canada (CIC) will mail your PR Card to you, after the information and photograph on your Confirmation of Permanent Residence document is confirmed by a CIC official when you arrive in Canada.

You can find the processing times for new PR cards on the Immigration, Refugees and Citizenship Canada website in the Check application processing times section.

It states that it is currently taking 58 days to process a new PR card.

Regarding your third question,

3. We have just given our passport for PRTD stamping to VFS. How can i request for multiple entry PRTD?

You can find some information on the Immigration, Refugees and Citizenship Canada website in the Applying for a travel document (permanent resident abroad) (IMM 5529) - What Happens Next section.

Here is an excerpt,

Travel document counterfoils are normally issued for a single entry to Canada. If you meet the residency obligation but are residing outside of Canada on a long-term basis (for example, if you are a permanent resident accompanying a Canadian citizen spouse), you may want to request a long-term multiple entry travel document. To do so, you should include a cover letter explaining your circumstances and requesting a multiple entry travel document. These can be issued for up to five years but cannot extend beyond the expiry date of your passport.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.
