Questions About PR Status and Days Required
PMM
|
Hi
Hi there
I got the confirmation regarding the canadian PR so now we (Me, my spouse & two children) have to enter the country before the same got expired i.e before 24th May 2016.
My question is that if we enter the country just for 15 days & exit but again we enter on a later date after settling my affairs in my native country, should we be receiving the PR card during that period or we have to provide some mailing address where it got delivered ?
1. Yes, you either have to provide an address in Canada for delivery of the PR cards, or if you don't have one, you will have 6 months to provide ones. 2. Note that when you return if you don't have your PR cards, you will have to obtain a PR travel document to re-enter Canada on a commercial carried. You can only get a PR TD at an overseas office.

Do I have to fly directly from my country?

Hi
Many thanks PMM. May I also ask if I must choose the Pearson Airport for landing purpose, or if just any airport in Toronto will do? I am asking this just to play safe, as I will most likely choose flights that arrive at the Pearson airport if at all possible. Thanks in advance again.
Hi
Hi, I got the COPR for my family and am planning to make my first landing in Toronto as part of my family trip to New York. Basically I plan to fly from HK (where i'm currently living) to NY, stay for a few days, and fly to Toronto (perhaps Pearson airport), stay for about a week, and then fly back to NY and then HK. (I will also leave an address for my relative in Toronto to receive the PR card.) Wonder if my plan makes sense or not. For instance, do I have to fly from HK directly to Toronto for the purpose of first landing? A thousand thanks in advance for some advice please, as I will have to confirm the air tickets shortly.
1. There is no requirement to fly directly to Canada to "land"
PMM
1. Since Pearson probably receive over 95% of the international traffic, compared to Billy Bishop airport.

Sponsorship Appeal Package
PMM

Hi
Hello,
My application to sponsor my spouse was refused in December 2015. In the appeal, I must prove that my marriage is genuine and "in good faith".
Question 1: what documents do I use to prove so?
Question 2: once I have collected all the documents I need, how do I put them in a package? Put differently, how do I compile a bunch of documents/photos in an organized and logical manner?
Looking forward to all or any helpful advise. thanks in advance!
1. You have to act quickly, you realized that you only have 30 days to submit an appeal from the date that you received the refusal. 2. Sponsorship appeals are not usually a do it yourself proposition, you probably should have legal representation. 3. You can start your reading here: http://tinyurl.com/h36sa5g 4. Also check the following for rules: http://www.irb-cisr.gc.ca/Eng/BoaCom/references/procedures/Pages/ProcessSpoPar.aspx

Sponsorship Appeal Package

Hi
Hi, So I submitted my appeal within the 30 days on Jan. 5th(ish) 2015. I still haven't received any response from the IRB regarding the date of my appeal or any next steps. I also do have legal representation, but I do not have full faith in that representation (i.e. I am not satisfied with their "help"). I am trying to gather and organize things before any official date is set so that I am not scrambling last minute. I would really appreciate it if I could get any sort of indication of how to organize the file (i.e. in what order should I have the documents complied) to present at the appeal.
Hope that's a little more clear...
Thanks so much!

1. You will receive the "blue book" from IAD about 4 months after the appeal is served on IRC. The blue book outlines IRC's case and what you will have to address to prove that it is a valid marriage. Depending on your location, the appeal could take up to a full year for scheduling, if CIC refuses to participate in an ADR (Alternate Dispute Resolution). 2. Your first step should be be to get authorization from your spouse and obtain the GCMS notes. see: http://www.cic.gc.ca/english/department/atip/requests-atip.asp This will/should show you the reasoning of the visa officer as to the refusal. 3. If you don't have confidence in your legal advisor, then you should probably find someone who you are more comfortable with. Your advisor should be outlining the steps that need to be taken. 2. You

New Health Card and SIN number
PMM

Hi
Me and my family have work permits that expire in 2 years. We already have health cards and SIN numbers. Yesterday we got our Permanent Residence and we are waiting for the cards. Do we need to get new health cards and SIN numbers?
1. Yes, for the SIN you go to a Service Canada office with COPR and get a permanent SIN 2. You then go to a Service office of the Province where you have your health card, and show your PR status.

Hi
Hi friends,
What if I cannot present my vaccination record (which has not been updated for many years in any event) during my first landing. Any advice would be appreciated please. Thanks.
1. It is not asked for at "landing" 2. Basically you will require it for children enrolling in school.

How will I receive the PR card?
PMM

Hi
Hello all,
I am coming to canada on April, 2016 but for a short time. I have to leave before getting my PR card. So, my question is now CIC or the authority will send the PR card to the address in canada that I will provide or I have to collect it by physically?? Please let me know. Please also let me know can my sister send me the PR card through Fedex or DHL to Japan???
Masum
1. In most cases they will mail to the address in Canada you supply and your sister could mail/courier overseas. 2. In some instances where the VO determines during your "landing' that you are not taking up residence in Canada, you will be told to apply for the card with and address once you take up residence, it doesn't happen often, but it does happen.

Hi
Hi,
I became permanent resident in Sep.2010...I was absent from Canada for 14 months between 2013 and 2014...my PR card is expired now and needs to be renewed...Does my absent causes any problems for the renewal?
1. It shouldn't as long as you have 2 years of residence in the 5 years prior to the date you apply to renew your PR card.

Want to Land in Edmonton instead of Toronto
PMM

Hi
Hello dear sirs
We got my COPR and Entry VISA on Passport up to valid to 2016/05/18 . I applied under the federal skilled trade program, my COPR Category is MST type and my Visa is IM-1.
My COPR reads "Destination:, TORONTO ,ON " but we want to land in Edmonton because we will live with friends for a few months and then would like to reside permanently in Edmonton, Alberta.
My questions are: 1. Should we land at Edmonton instead of Toronto.? If Not then how much time we have to stay at TORONTO
1. As long as you weren't selected under the Ontario PNP program you can "land" and live where ever you wish in Canada. Note that you can "land" in Quebec without a CAQ or proof of onward transportation.

Child Sponsorship

Hi
Hi, I'm a permanent resident (PR) here in Canada for about 1 year and 6 months because of my husband and I want to get my 8 years old daughter in the Philippines. The question is what espacific application form do I need to my dependant child. Because before I go here in Canada I already declared her in my application form. And I include my daughter as a non-accompanying dependent in my permanent resident application form and she also has a medical exam... I want to know how long will it take to get my daughter and what application form do I need...pls..help me because I want to be with my daughter...I hope you can help me thank you!
1. You use the application forms at www.cic.gc.ca (system is really slow these days, so can't post the actual link) 2. Select, Immigrate, then on the next page, sponsor your family, then spouses and dependent children.

Validity of my PR Card
PMM

Hi
Dear Friends,
I need your help to check the validity of my PR Card. I landed in Canada with my immigration documents in June 2011. Applied for my PR Card and came back. Due to some discrepency in the picture, my PR Card was ultimately issued in August 2012, when again I went to Canada. Now my PR Card is valid till July 2017 and I am outside Canada. Please let me know, upto what time I can remain outside Canada?? Till June 2016, when I am completing my 5 years from the date, I entered in Canada OR till August 2017, when my PR Card is going to expire. Kindly help. Thanks
1. Your 5 year clock starting ticking on June/2011 when you "landed". You must reside in Canada for 2 years from June/11 to June/16 to maintain your PR status. 2. The date on the PR card is immaterial, it just indicates that you are a PR. You still have to meet the residency requirements.

Spouse Sponsorship - Child/Unemployment Benefits
PMM
|
Hi
Hello everyone. I am a Canadian citizen and I have submitted a spouse sponsorship application for my common-law spouse. This was an inland application as she lives here with me in Canada.
The approval process is very long and we are about 2 years away from the final approval.
She currently has a work permit.
My question is - if we have a baby in the near future - is it a good idea if she collects the EI maternity benefits? She is legally allowed to do that and already applied for it.
I heard that if she collects the employment insurance benefits during the application period, our application might get revoked. Is that true?
Also, will the same rule also apply to regular unemployment benefits received?
She hasn't received any EI benefits yet, but if there is anything that might jeopardize the application, we will cancel the EI support application.
Can you please help?
Ivan
1, You heard wrong, EI is not social assistance, it is an insurance scheme, you pay in while you work and collect when you are unemployed.

PR card Cancellation after Divorce
PMM

Hi
1. The OP can "cancel" his spouse's Permanent Residence. 2. If his spouse has condition 51 on her PR card, then he should inform IRCC that him and his spouse are not longer co-habitating. 3. If she she doesn't have condition 51 on her PR card, then he should inform IRCC if he feels that the marriage was one of convenience. 4. He should inform IRCC in writing about the situation by using the webform and to keep a copy. http://www.cic.gc.ca/english/contacts/web-form.asp

Hi
1. Wait a couple of weeks, the PR cards are usually mailed separately. If you don't receive it, there is a good chance that there is a problem with the photos. If there is, IRCC will contact you.

Activation of PR without Principal Applicant?
PMM
|
Hi
1. If you are from a visa exempt country, you will be asked to submit copies of passports and you will be sent a Confirmation of Permanent Residence in the mail. If you are from a country that requires a visitor visa to enter Canada, you will be requested to send your passport to the processing office, where a "visa sticker" will be placed in your passport and the COPR will be mailed back with your passport. 2. No, you can't "land" before the principal applicant.
