How can I sponsor my child born outside of Canada?

Hi Everyone,
I just wanted to confirm whether or not my husband and I (PRs) have to be working in order to sponsor our child (born outside of Canada).
Would it be better for him to just go to Canada alone to start the process or should we attempt to get a TRV?
Please advise

Question about Permanent Residency Requirements
Moderator
|
Hello,
Thank you for sharing your questions with us.
Regarding your first question,
1- This 3 yrs time can be used as one time -window OR visits randomly can be sumed up to 3 yrs??
Yes, to meet these residency obligations, you must be physically present in Canada for at least 730 days (2 years) in every 5-year period.
This means that you can spend a total of up to 3 years outside of Canada during a 5-year period. However, if you leave the country for an extended period of time, it is up to you to prove to Citizenship and Immigration Canada that you will be able to meet your residency requirements.
You can stay outside for up to 3 years straight, however, many of our users have recommended that this not been done. This is because in the event you have stayed outside for the total of 3 years, return to Canada and then something happens and you are required to leave Canada, you will not be able to meet your residency requirements.
Regarding your second and third questions,
2- I heard from people here that the new law is one must be present in CA for six months in every one yr ,is this true ?
and
3- NOW 4 yrs are required in six yrs to maintain permanent residency ?
You must be physically present in Canada for 183 days (minimum) per year in 4 out of 6 years for Citizenship Eligibility.
You must be living in Canada for 4 years (1,460 days) out of 6 years is for citizenship eligibility.
If you have any other questions or concerns you may also want to contact the Citizenship and Immigration Canada (CIC) Call Centre directly.
I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Looking for a Survival Job
Moderator
|
Hello,
Thank you for sharing your situation and question with us.
From what we have heard from many of our users, a lot of times a first job in Ontario or anywhere in Canada may be a survival job, like you have mentioned, "a reasonable job for survival".
There are some "typical" survival jobs. Some jobs that are considered survival jobs are, cashiers, customer service representatives, factory workers, or taxi drivers.
Some may wish to take a survival job because it may assist in building a network related to their profession or trade. The amount of money that you can earn in these survival jobs can vary. You may want to look at some examples in the Job Bank . This tool was previously referred to as the "Working in Canada" tool. It is important that you connect with the nearest employment service as soon as you arrive or now if you have already arrived.
Your user ID indicates that you are in Calgary.
You can find some helpful information in this Alberta Human Services website.
Please note that what this statement "survival job" means is that in some cases, the jobs mentioned, are jobs that may be jobs that many may get when first arriving. They may accept these positions in order to make ends meet or pay their bills until they can get a position in their desired field.
We are not suggesting anyone should or shouldn't take these positions.
I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Proof of Funds and Documents Required
Moderator

Hello,
Thank you for sharing your questions with us.
Regarding your questions,
1- I would like to inquire about the minimum amount of money, if any, I should bring with me during landing to activate my PR status. Do I must carry the funds required to apply to immigration (i.e. the $11,931 for one principal applicant), all in cash?
Or would a bank statement/letter from my bank in my country of residence be enough to show to the officer and I can carry any amount of money I want?
Does the duration I am staying for post landing affect how much money I should bring with me?
Or is it sufficient to have a bank statement/letter from the bank in my country of residence as a proof that I have enough funds?
Does the period of my stay post the first landing impose a specific minimum amount of cash on hand requirement?
According to the CIC Website,
Unless you are currently authorized to work in Canada and have a valid job offer from an employer in Canada, or you qualify under the Canadian Experience Class, you must show that you have enough money to support yourself and your family after you get to Canada.
You cannot borrow this money from another person. You must be able to use this money to pay the costs of living for your family (even if they are not coming with you).
You will need to show proof to the Canadian visa office in your home country that you have enough money when you apply to immigrate.
The amount of money you need to support your family is set by the size of your family. We update these amounts every year.
[...]
You do not have to show that you have these funds if:
*you have a valid offer of arranged employment in Canada AND *you are currently working or authorized to work in Canada.
and
These funds could be in the form of:
*cash *documents that show property or capital payable to you (such as stocks, bonds, debentures, treasury bills, etc.) or *documents that guarantee payment of a set amount of money, which are payable to you (such as bankers’ drafts, cheques, travellers’ cheques or money orders).
Regarding your questions,
2- Do I need to carry photographs for the PR card application or it will be the same photo on my COPR?
Should I carry photographs for the PR card application or will they just use the same photo on my COPR?
Citizenship and Immigration Canada (CIC) will mail your PR Card to you, after the information and photograph on your Confirmation of Permanent Residence document is confirmed by a CIC official when you arrive in Canada.
Regarding your question,
3- Do I need to carry original copies of my birth certificate, educational certificates, work letter etc. to show to the officer during the landing interview?
Will the officer need to see documents like birth certificates, educational degrees, work letter etc. during landing?
You can find some helpful information in our Settlement.Org What documents should I bring with me when landing in Canada as a new immigrant? article.
I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Can Immigration revoke my Permanent Residency?
Moderator

Hello,
Thank you for sharing your situation and question with us.
If you are concerned about the conditional permanent resident status, it only applies to partners if their spousal sponsorship application was submitted on or after October 25, 2012 AND:
*they were in a relationship for 2 years or less when they applied; and *they did not have any children together when they applied.
Here is some additional information regarding losing your permanent residence from the CIC Website,
Losing your permanent resident status
Losing your permanent resident status does not happen automatically. You cannot lose your permanent resident status simply by living outside of Canada long enough that you don’t meet the residency requirement. Unless you have gone through an official process, you have not lost or given up your permanent resident status, even though you may not be eligible to return to Canada as a permanent resident.
You may lose your permanent resident status if:
An adjudicator determines that you are no longer a permanent resident following an inquiry
A visa officer determines you do not meet the required residency when you apply for a permanent resident travel document or temporary resident travel document.
You may lose your permanent resident status in one of the ways described above if:
*you do not live in Canada for two out of five years; *you are convicted of a serious crime and told to leave Canada; or *you become a Canadian citizen.
You do not lose your permanent resident status if your PR card expires.
In terms of being deported by your sponsor, it is not likely.
Regarding deportation, if you are a permanent resident and are convicted of a crime you could lose your permanent resident status, be deported and might not be able to come back to Canada.
If you have any concerns regarding your situation you may want to contact the Citizenship and Immigration Canada (CIC) Call Centre directly for some additional information.
I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Re-entering Canada after Landing in 2014

Hello Manish,
In order to fulfill the residency requirements, a permanent resident must be physically present in Canada for at least 730 days (2 years) in every 5-year period.
This means that they can spend a total of up to 3 years outside of Canada during a 5-year period. However, if you leave the country for an extended period of time, it is up to you to prove to Citizenship and Immigration Canada that you plan to continue to live in Canada.
Most recommend not staying outside Canada the total allowed time because in the event you have to leave Canada once you re-enter Canada for an emergency you would have already used up the allowable time to be outside Canada.
We cannot tell you how long you should stay outside Canada.
We suggest that you contact the Citizenship and Immigration Canada (CIC) Call Centre directly for to confirm this information and for some information specific to your own situation.
I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.
