1. Yes, as long as you reside in Canada for 2 years in every 5 year period, you maintain your PR status.

1. No, it is not a same day process, usually about a week or so, can be longer.
2. You would submit your application to the Visa Application Centre in Dusseldorf see:http://www.vfsglobal.ca/canada/germany/
3. The application would be processed in Vienna.

Baby Born Abroad to Canadian Citizen + COPR Spouse

1. The child will be a Canadian citizen born abroad as your spouse was naturalized, she will have to apply for proof of citizenship for him or her, note the child will not be able to pass on citizenship to any of his or her children born abroad.
2. You will need proof of citizenship for the child and a Canadian passport, they can be applied for abroad in conjunction with each other before s/he can travel to Canada.

1. If you are a Canadian citizen residing abroad with your spouse she should apply for a PR Travel document, as she would have maintained her PR status residing with you.

We are planning to depart for Canada as soon as the baby is born.

Time between expected birth and the expiry of COPR is only 45 days. Current application processing times for proof of citizenship is 5-6 months.

Since the baby will be born in a country that doesn't require a visa in Canada, we are planning to travel with the baby's birth certificate and passport from country of birth to Canada.

Once we land in Canada, we plan to obtain proof of citizenship.

Of course we understand that the baby will be a visitor to Canada until proof of citizenship is obtained and will have to leave the country and possibly re-enter if the proof of citizenship doesn't come during his period of stay as visitor in Canada.

Please let me know if we will need proof of citizenship for the baby BEFORE we enter Canada on COPR? Or can we enter Canada and then apply for child's proof of citizenship.

1, Unless the child is born in the US and is a US citizen, s/he will require an ETA to board a plane to Canada. As the child has a claim to Citizenship IRCC will NOT issue an ETA. So you are probably have to contact the nearest consulate and hope they will either issue a limited validity passport for the child or a facilitation visa. See: http://tinyurl.com/ya2768v3 which is probably your best bet.
2. If the Consulate issued either a limited validity passport (you would have to submit the proof of citizenship, but it wouldn't have to be complete) then it would carry on processing, if a facilitation visa is issued, then you will have to apply for proof of citizenship in Canada.

Now I have 2 options mentioned below

1 Should I apply again with the fresh sponsorship process with fee.

2 Is there any other provision to apply.

Should I postpone my marriage till i get my PR card.


1. If you marry before you "land" your COPR is no longer valid. You will have to contact the processing office and add your new spouse to your application. If you "land" before your spouse is examined, (new application, medical, security check, police reports) you can never sponsor the spouse and you may be reported for misrepresentation.
2. If you "land" and then return and to your country and marry, you will have to return to Canada to sponsor you spouse. Permanent Residents must be residing in Canada to sponsor a spouse.

It doesn't matter, he has to declare the kids, submit proof the mother has custody and either have the kids medically examined or a statement from the custodial parent that they refuse the medical and they realize that the children can't be sponsored in the future. You don't declare the children, that is misrepresentation and can result in a ban from Canada for 5 years.

1. No, Citizenship requires actually physical presence (Federal/Provincial employees and Military are exempt) residing with a Citizen abroad only preserves your PR status.
2. You should note that you must be in Canada to apply for a new PR card with a Canadian residential address.
