Hi

Hi,

I am a single mom with 3 kids.I've been away with them for more than 8 yrs working in other country and then came here in Canada.I applied for PR including in the application my kids so that we will stay together. My eldest won't be able to come with me coz she has a family now but my 2 kids (16yrs old and 13yrs old) changed their mind that they don't want to be with me here in Canada rather to stay with my parents and sisters where they grew up.They chose to stay with them than me.My question is.Does my PR status will be revoke because my children don't want to come here?

Conditional PR or PR

Hi

Hi

I have applied for an Inland Spousal Application. My wife and I have been married for 5 years and we married in Toronto and have our marriage certificate is from Toronto.

We have 1 child and another one on the way. We have been living overseas for most of our 5 years of marriage. We have been living together for about 3 years and the rest of 2 years we were apart due to our travels.

As I understand if I am correct, the situation for us is that we WILL NOT be subject to a 2 year conditional permanent residency (i.e. MUST live together FOR 2 YEARS) after a decision has been made on my spousal application because we have been living together for 3 years now.

So my question is, will I be granted Permanent Residency after a successful application decision has been made or a Conditional Permanent Residency or if different what would I be granted most likely.

I hope my question makes sense.

Thank you

1. Your PR won't have any conditions on it.

Abusive Partner - Deportation Possible?

PMM
Hi

Ok, so here is my story. I'll try to be clear and concise.

I am a Canadian citizen (2003, got my citizenship) who went back home (Philippines) in 2004 to study. I stayed there for about 5 years, just after I finished my studies. Anyways, in 2007 I met a girl and married her and soon afterwards our son was born (2008). I came back here in Canada on 2009 because I could not make ends meet with my job there in the Philippines and i knew that it would be better here to work. After 3 years (2012), I was able to sponsor my wife to come to Canada, my son being a Canadian Citizen already by virtue of me being a Naturalized Canadian citizen did not need to be sponsored. So they arrived here during the 1st quarter of 2012. Now for the purposes if this thread, I need to mention that even before I married my wife, we were already fighting and bickering with one another but because she was pregnant at the time before we got married, I thought I needed to "own up" to my actions and go ahead with the marriage even though there were already "redflags" in our relationship and that we should not have gotten married. Anyways, I thought she would change for the better once she got here but the situation only got worse. She is verbally and physically abusive towards me and my son who is now 7 y.o. And we have a daughter who is turning 2 on january of 2016.
Now on to the details about her abusive behaviour: She constantly say bad and expletive words to me when she gets angry for the smallest of reasons and she has in more than one occasion physically hit me with blunt objects and threw stuffs at me like our son's toys, she hit me with a extension rod, with the buckle of a belt and an umbrella. Not to mention she has also hit my son and kicked him on more than one occasion. To top it all off, she has the audacity to kick us out of our apartment, which is under my name as I am the tenant, when she is angry. She also yells on the corridors and throw my clothes out the window to the balcony. she has no respect to me whatsoever. I am paying for everything including hydro and providing my family with basic necessities. I have documented her abuse during her outburst of wrath and have pictures of the bodily harm she has caused me and also my son. On more than one occasion, she has pinched my son on the arms and on his waist resulting in an unwanted mark or bruise. Also when she hit me with a extension rod, it resulted in contusions on my shoulders and arms.
I have had enough already. I am only now staying because of my two kids and I am seriously contemplating divorce and having a peacebond filed against her. I did not neglect her or physically harm her in anyway when she physically hit me because i know that if I touch her or lay a finger at her, then the cops would be all over me and I could go to jail.
In light of this horrible situation i am in, my question would be is, what are the chances of me getting custody of our kids and she be deported. She is still a PR in Canada.

P.S. I know that I have been taken as a fool by my wife by all accounts but I am fed up and I have "waken" up from her manipulative attitude.

You must first defeat Shenlong to stand a chance against me!

1. Whether you get custody of your children is matter for the courts.
2. No, she will not be deported, she is a Permanent Residence.

Conditional PR or PR

Hi

Thanks

After I receive a non conditional PR, do I apply for full citizen after 5 years? I'm unsure about that.

1. For citizenship you require physical presence for 4 years in the 6 year period after "landing". If you didn't leave Canada for 4 years after the date of "landing" you could apply after the 4th year.

1. Mathematically, to have an average, some applications must be processed in less time than the average and some longer than an average.

Visitor Record same as TRV?

Hi

Hello,

I currently reside in BC. I have a Indian passport with valid co-op work permit.

My daughter is 9 years old and holds a US passport. We crosed the border and came back into Canada on Jan3rd and she got a Jan3rd stamp on her passport.

I am going to apply for PGWP this month end. The border agent told us that she needs to apply for a Visitor record if she plans to stay in country for more than 6 months.

Is Visitor record same as TRV. Online i cant see any mention of Visitor record. Can someone help
Thanks

Sunil S

1. No, a TRV is for Non visa exempt persons to enter Canada, a visitor record allows them to remain in Canada.
2. She would need to extend as a visitor : http://www.cic.gc.ca/english/visit/extend/visa.asp

Hi

Hi

I have question if anyone can help.

My sis is currently filling an application to sponsor her husband. My sister is PR and she has a one year old daughter which was born and currently living in Canada with my sister.

She was wondering if her husband have to put the child in the additional dependants/declaration form or additional family information form ? They dont have any other child and the one year old was born in Canada.

Thank you,

1. No, as Canadians/PRs are not included in the application. The child would only be listed on the IMM 5406, assuming her husband is the father. If he is not the father, then the child is not listed.

Permanent Resident Travel Document from Pakistan

Hi

I've landed November 06, 2015 and still waiting for my pr card, But i need to go back to my country by February 2016. I don't know if my pr card will arrive that time. If ever it won't arrive yet, how and where to apply for Permanent Resident travel documents. Can i get out of the country (Canada) without those travel documents? What are the requirements?

Best Regards

CAPME1955

1. You don't need a PR card to leave Canada, just to return, if you don't have one by then, you will have to apply for PR travel document at Islamabad.
2. If it arrives while you are in Pakistan, have someone courier to you.

Do I have to fly directly from my country?

Hi

Hi, I got the COPR for my family and am planning to make my first landing in Toronto as part of my family trip to New York. Basically I plan to fly from HK (where i'm currently living) to NY, stay for a few days, and fly to Toronto (perhaps Pearson airport), stay for about a week, and then fly back to NY and then HK. (I will also leave an address for my relative in Toronto to receive the PR card.) Wonder if my plan makes sense or not. For instance, do I have to fly from HK directly to Toronto for the purpose of first landing? A thousand thanks in advance for some advice please, as I will have to confirm the air tickets shortly.

1. There is no requirement to fly directly to Canada to "land"

Can my Proof of Funds be in US dollars?

PMM
PMM
Hi

I know from the CIC website that funds can be brought in to Canada in the following forms at landing:

Cash
Securities in bearer form (for example, stocks, bonds, debentures, treasury bills)
Negotiable instruments in bearer form (for example, bankers’ drafts, cheques, travelers’ cheques or money orders)

My question is if it's in cash does it matter what currency it is? Specifically, is it allowed to bring all the currency in USD? Are there any limitations to this?

1. It doesn't matter which currency your Proof of Funds is in, as long as it is convertible in Canada. Note if you are carrying over $10K in currency and other types of funds, it must be reported if you are leaving the US and reported when you enter Canada. There are no taxes, but it must be reported.
