She landed and left Canada before the residency requirement was in force in 2002. Back in the 2002 she would not be able to fulfill the 2 years in every 5 year period. Plus her mother who lived in the home country at that time was diagnosed with stage 4 lung cancer in 2003 and passed away in 2006. She thought she lost her status that's why she didn't look into that.

She had been living with her brother(who is a Canadian citizen since 1998) and his family in home country in the past 20 years until her brother and family immigrated and moved to Toronto in 2017. This is the reason why she is thinking about moving back to Canada.

It is a bit frustrated as all she needs is coming back to fulfill the residency requirement but looks like CIC is not allowing that.



One more question about the second option you mentioned. She has no problem coming in the Canada via her current country's passport. But how can she proved that she live 2 years in Canada since she does not have any legal document to set up anything. For example, she will need the legal document to re-active the SIN number?

Totally understand I am asking for help on a weird situation. Any information is helpful.

1. She doesn't have to prove ongoing studies, but if she wishes to use her studies as proof of English, she probably needs completion.
2. Both require proof of language.
3. No, there is no on line tests available.

1. Not until you are in Canada and in compliance with your residence obligations. So you would have to reside in Canada for 2 years, without leaving before extending your PR card.

1. Your application was processed in 2019 and was refused, so there would be no refund of the fee.
2. If you submit a new application, it will be with new fees. It is the full $630.

1. No, taking care of your child doesn't preserve your PR status.

2. It appears you no longer meet your PR obligations residing in Canada for 2 years in every 5. Before you could sponsor your child, you would have to be in compliance with that obligation. In other words "if" you were able to enter Canada without being reported, you would have to remain for 2 straight years without leaving to meet the obligations.
3. Your only other choices are apply for PR Travel Document overseas, and demonstrate that you had Humanitarian grounds for remaining abroad, if you are refused you would be given appeal rights. Or renounce your PR status, and re-apply, if you are eligible under Express Entry, you would need about 470 points to qualify.

1, You realize the posted processing time is 137 days? Your application won't show up until it is sent for processing in Sydney, somewhere around October.

1. No need to inform CIC as they aren't interested in your plans. All that they are interested in that to maintain your PR status that you reside in Canada for 2 years in every 5 year period. It is a rolling 5 year period. If you spend 3 years outside Canada in the Czech republic, you may have difficulty meeting your residency obligations.

1. You can enter, but there is a chance you will be reported for not meeting your RO. If you are, then you will be given 30 days to appeal, the decision. The IAD will determine if there is any mitigating factors why you shouldn't lose your PR status. If you are admitted without being reported, you would have to remain in Canada until you are in compliance with your RO.
2. No, there is no changes in RO obligations, 2 years in every 5 year period is pretty generous as it is.

1. No, no access to benefit just by being married.

2. Once the sponsorship is submitted, (if outside Canada) you won't be eligible for anything until you "land" If the application is an "in Canada spousal" then you submit an application for an open work permit with it. Takes about 4 months for the work permit to be issued. Some provinces may allow you to apply for their medical services plan, most others won't until you are Permanent Resident.

1. If they don;t appeal, then their PR is gone. To maintain their PR status they would have to win the appeal.. Probably should seek legal representation, it isn't a really do it yourself project.
