Hello,

Thank you for sharing your situation and question with us.

As you may already know, the sponsorship guidelines only state that you cannot be an undeclared bankrupt or be receiving social assistance.

In your case, if you do not have employment, IRCC will likely ask you to demonstrate how you can support your spouse in Canada without any income.

We suggest that it is best if you contact the Immigration, Refugees and Citizenship Canada (IRCC) Call Centre directly for information specific to your situation and for responses specific to your questions.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

PR Card Renewal and Business Incorporation

Hello,

Thank you for sharing your situation and question with us.

We can appreciate that you would be interested in this type of information.

In terms renewal of the PR card, yes, the IRCC website states that if your permanent resident (PR) card is expired or will expire in less than 9 months, you can apply for a new card. This does not mean that you are obligated to apply for renewal at this time.

It is best to apply to renew your PR card when you are completely sure that you have more than fulfilled your residency requirements.

If your PR card expires, it does not mean that you have lost your PR status.

In terms of your second question, you can find some detailed information in the Immigration, Refugees and Citizenship Canada (IRCC) ENF 23 Loss of permanent resident status enforcement manual. Here is an excerpt,
6.2 Canadian business

The definition applies to both large and small businesses, and includes:

  • federally or provincially incorporated businesses which have an ongoing operation in Canada;
  • other enterprises that have an ongoing operation in Canada, are capable of generating revenue, are carried out in anticipation of profit and in which a majority of voting or ownership interests is held by Canadian citizens, permanent residents or Canadian businesses;
  • enterprises which have been created by the laws of Canada or a province.

Note: It does not include businesses that have been created primarily for the purpose of allowing a permanent resident to satisfy his or her residency obligation while residing outside of Canada R61(2).

Any additional questions you may have, you may want to contact the IRCC Call Centre directly.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Hello,

Thank you for sharing your situation and question with us.

We can appreciate that you would be interested in what your rights are in this situation and how to find a solution to this issue.

Although this is not a repair issue, it certainly is a maintenance issue.

You can find some information on the Social Justice Tribunals Ontario website in the Landlord and Tenant Board Frequently Asked Questions section.

Here is an excerpt,

What should I do if repairs are needed to my building or unit?

Talk to your landlord first about the problems. Put the problems in writing and give the list to the landlord or the person who takes care of maintenance (for example, to the superintendent or property manager).

If the landlord refuses to do the repairs or you think that the landlord is taking too long to deal with the problems, see the brochure: Maintenance and Repairs.

You may want to contact the nearest Community Legal Clinic for some information and assistance regarding how to proceed.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Hello,

Thank you for sharing your situation and question with us.

We can appreciate that you would be interested in this type of information.

Unfortunately, your mother staying with your Canadian Citizen sister abroad does not help her maintain her permanent residency status.

It only applies in the following circumstances listed in the Immigration, Refugees and Citizenship Canada -How long must I stay in Canada to keep my permanent resident status? FAQ. Here is an excerpt,

Residency Requirement

To maintain their status as a permanent resident, you must live in Canada for at least two years within a five-year period. During this time you must be here physically. The two years may not need to be continuous.

An officer can confirm if your time in Canada counts when you:
  • re-enter Canada, or
  • apply for a permanent resident card.

Time spent outside Canada may also count towards the two years if you are:

  • travelling with your spouse or partner who is a Canadian citizen,
  • a child travelling with his or her father or mother who is a Canadian citizen,
  • an employee of (or under contract to) a Canadian business.

It may also count if you are:

travelling with your spouse or partner who is a permanent resident and works full-time for:

  • a Canadian business, or
  • the public service of Canada or a province,

If you are in Canada, you may want to contact the IRCC Call Centre directly for some information specific to your mother's situation.

You may also want to contact a Lawyer or a reputable, registered Immigration Consultant who is familiar with Canadian immigration issues for some advice and assistance with this process.

I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.
