Same Day Landing, Leaving and COVID-19 Protocols

Hello there,
Thank you for sharing your question and situation with us. Please note that we have assumed that you are a fully vaccinated traveller, as defined by the Government of Canada.
There are some risks if you leave Canada on the same day of your CoPR landing and you should seriously consider changing your departing flight.
If you give Immigration, Refugees and Citizenship Canada (IRCC) an address in Canada, but you leave before the card is mailed to you, you can ask your family or friends who live at that address to send you the PR card. You will need your PR Card in order to re-enter Canada, and it should be noted that having it mailed to you outside of Canada is a significant risk.
If you arrive and do not give IRCC a Canadian mailing address (or you do not receive your PR Card), and you depart Canada, you will need to apply for a Travel Document (Permanent Resident Abroad) before you try to re-enter Canada. This application must be submitted to a Canadian visa office abroad and may take approx. 6-8 months to process.
This Travel Document can only be used once. Further, the Travel Document is issued at the discretion of the Visa Officer and they will consider the reason for your departure from Canada, the country you went to, etc.
Upon your entry to Canada at Pearson International Airport, the border services officer may notify you that you have been randomly selected for an arrival test. You will have your PR interview before getting the arrival test.
If you are randomly selected for a mandatory arrival test, you must quarantine and wait for the results at your final destination inside of Canada. More detailed information can be found here.
We hope that this general information is helpful and we recommend that you seek legal help from a lawyer or a licensed consultant familiar with Canadian immigration to obtain assistance about your particular circumstances.
Please let us know if you have further questions.
Sincerely,
Your Settlement.Org team

Hello,
Thank you for sharing your questions with us! We are happy to provide a high-level answer to your question. In order to sponsor an adopted child, you must complete a sponsorship application that is separate from the family sponsorship application. You can find the application here. You would have to obtain information for the form of Medical Condition Statement [IMM 0133] concerning the adopted child’s medical condition. On the form, you would put yourself, the adoptive parent, under the title of parent. The only other form that asks for the name of the parents would be Schedule A [IMM 5669]. This is to be completed by the principle applicant, aka the person you are sponsoring. This is a form used for all applicants, not only adoptive children, and so the adoptive parents should be named as the parents. Please let us know if you have further questions.

extend WP while waiting immigration PR decision

Hello,
Thank you for sharing your question and situation with us. Please note that we have assumed that you have successfully submitted your paper-based PR application through the Provincial Nominee Program (PNP).
There are two ways to check the status of your application. First, you can use the online tool and it provides daily updates on your application status. Second, you can create an online account and link your paper application. By doing this, you will get the detailed application status in real time and the messages about your application online instead of by mail. More detailed information can be found here.
Since it has been almost 24 months since you submitted your application, we encourage that you also contact the IRCC as soon as possible through their web form.
Since you have the employment restriction as a condition of your nomination, you are not eligible for a Bridging Open Work Permit. You must apply to extend your current working permit before it expires. You will either need a Labour Market Impact Assessment (LMIA) or have your employer register the job offer through the employer portal and qualify via the International Mobility Program (IMP).
If your wife also applied for PR through the PNP without an employment restriction and has received a positive eligibility assessment (a PNP Certificate and the AOR), she should be eligible for a Bridging Open Work Permit. Also, she needs to meet the general eligibility requirements for a work permit.
If your child is a minor and currently lives in Canada, they do not need a study permit to attend pre-school, primary school, or secondary school if a parent is allowed to work in Canada. However, should you wish to travel, then we recommend getting a Study Permit for the child. Detailed information on studying in Canada as a minor can be found here.
We hope that this general information is helpful and we recommend that you seek legal help from a lawyer or a licensed consultant familiar with Canadian immigration to obtain assistance about your particular circumstances.
Please let us know if you have further questions.
Sincerely,
Your Settlement.Org team

Hello everyone,
In planning my travels for the end of the year, I checked all my paperwork to start getting things in order and noticed that the expiration date on my PR card is 09 Oct 2023 but my online profile is 19 April 2019 (less than one year after date of issue).
Does this mean that I have to update my PR card before travelling? Or is that date on the card sufficient?
Since the issue of my PR in 2018 I have only left the country for one month.
Thank you in advance

Hi there,
Thank you for sharing your question and situation with us.
You may find helpful information in a similar question, here: https://discuss.settlement.org/topic43704-employer-initiated-relocation-for-pnp-pr--sinp.aspx
Here is an excerpt:
We have received some information from one of our legal researchers; and apologize for the delay. We hope you find their information useful:
Each province operates their own unique Provincial Nominee Program (PNP) which is designed by the province to help meet their economic and demographic needs. Typically, as a permanent resident of Canada, you do not have to inform any authority on your intent to move out of the Province. However, this may be different for a permanent resident who obtained their residency through the PNP. The mobility rights of an individual under the PNP program is subject to certain regulations (under section 6(3)(a) and (b) of the Canadian Charter of Rights and Freedoms) which creates several limits to mobility. This mandates that immigrants who obtained PR under the PNP should remain in the province which they applied for about two years to show their intention. This does not mean that a PNP applicant can not leave the Province. There are certain things that you can do before deciding to leave that will still show you had or have an intention to stay in Saskatchewan. This can include, but not limited to, 1. Actively looking for jobs within Saskatchewan, 2. Properly documenting your job hunt (include proof of your job applications), and 3. Exhaust all means of finding employment in Saskatchewan. From your situation, it appears that you have actively searched for a job even during the period of time you were working with another employer. It would be best if you could compile all your job applications during this time for proof. In the situation in which you do not get a job offer, or you are offered a job out of province that is for a higher position, then your move out of the Province may be legally justified. In your case, with proper documentation, you may be able to work in Ontario without any adverse consequences on renewing your PR card and obtaining Citizenship. It is highly recommended for you to contact the Saskatchewan Immigration Services directly for some confirmation on this matter as this may be decided on a case-by-case basis. Please keep in mind this is only legal information, it is not legal advice. If you want or need legal advice you will need to contact a reputable lawyer or the nearest Community Legal Clinic regarding your situation.
We hope this information is helpful.

PR CARD EXPIRED BEFORE 2 YEARS

Hello There,
Thank you for sharing your situation and question with us.
You may find useful information in the article on Settlement.Org, What are the residency requirements for permanent residents (PRs)? Here is an excerpt:
To meet these residency obligations, you must be physically present in Canada for at least 730 days (2 years) in every 5-year period. The 5-year period is assessed on a rolling basis. Immigration, Refugees and Citizenship Canada (IRCC) will look back at your time in Canada over the previous 5 years.
This means that you can spend a total of up to 3 years outside of Canada during a 5-year period.
IRCC may take humanitarian and compassionate reasons into consideration for your extended stay outside of Canada. However, this is up to IRCC and it would be best for you to contact the local visa office or IRCC via web form to get more details about her specific application and what kind of supporting documents you may require.
You may also want the advice of a reputable and registered immigration consultant or an immigration lawyer familiar with immigration law for advice regarding your situation.
Regarding biometrics, according to IRCC:
If you’re applying for permanent residence, you need to give your fingerprints and photo (biometrics). If you’re applying, or have an application in progress for temporary residence, you’re temporarily exempt from giving biometrics.
You can answer some questions to find out if you need to give biometrics.
We hope this information is helpful. If you have any additional questions, please feel free to post them here.

Hi Having business meetings outside Canada, I applied for urgent PR renewal supported by documents, tickets, hotel bookings, etc. I applied on 17/11/2021, received a confirmation receipt email on 23/11/2021 and the online status turned to DECISION MADE on 12/12/2021. Since then, no news at all, no card mailed, no invitation to collect it personally, or even no request of any additional information ! Landed on May 2016 for 2 weeks and left Canada. Since my return on August 2018 to end of 2021, I have stayed 740 days but not continuous, and in the beginning it was short periods due to my frequent business travels. I contacted a lawyer to ask what could be the reason on this delay, and he said maybe the officer is not satisfied of my file profile due to frequent travels, or because I barely completed the period required ! Could this be a valid reason for delay ? or a reason to refuse my file ? Please advise.

OHIP under Implied Status - Questions

Hi there,
Thank you for reaching out, and sharing your question with us.
The provincial government has given options to renew your health card online. And there is an option to renew both your OHIP and Driver’s Licence at the same time. You can also book an appointment online so you don't have to wait in long lines at the Service Ontario location of your choice. If you do not want to book online, it is advised to call ahead to ensure the location is open and learn about any restrictions that may be in place.
However, if you need a new photo you will need to visit a ServiceOntario centre. You will likely need to get your photo taken if:
- you are replacing your red and white health card
- your photo is 10 years or older
- you are turning 16 years old
- you are renewing in-person
- you are making a change to your name
- you received a notice in the mail from ServiceOntario to a Service Ontario location.
If you or someone you know is over the age of 80 there are other options for renewing your documents
If you cannot visit a ServiceOntario centre for a medical reason, you must have a physician or nurse practitioner fill out a Health Card Medical Exemption Request form.
If you would like to submit your feedback about the online process you can submit any comments or concerns through this provincial page.
We hope this information is helpful. If you have any follow-up questions, please feel free to post them to the discussion forum here.

Hi there,
Thank you for reaching out to Settlement.Org, the recommendations above share how to make a complaint and some of the options for folks who may have trouble reaching Service Ontario in person. This particular accommodation may be helpful:
If you cannot visit a ServiceOntario centre for a medical reason, you must have a physician or nurse practitioner fill out a Health Card Medical Exemption Request form.

On New Years eve a fire broke out at a structure neighbouring my rental unit. The fire was located in a commercial business (shop). The same landlord owns this establishment as well as the building where my apartment is located. The source of the fire was proven to be an electrical fault In the business itself.
Fortunately I was at home at the time noticed the smoke and promptly called 911. The FD arrived, at that point smoke was thick but few flames. However my apartment living room was next to the source but separated by a brick firewall. Still the Firefighters entered my apartment to check the extent of any fire, just a great deal of smoke. A front window in my apartment was smashed out to evacuate smoke with the firefighters proceeding to pull down ceiling and wall drywall in the living room area to check for any flame spread, there was none. In this process various items were damaged some seriously which i shall have to replace. Needless to say I was required to find accommodation at a friends house that night and have been out of my apartment since staying with friends. I did not have tenants insurance so the burden is mine to date.
The insurers were soon called in with their recommendation was for a complete restoration of the interior surfaces which required me to hire, move, and store monthly the contents of the apartment. There was also severe damage to the flat roof above my unit partially due to FD access. No hose water entered the unit. So a thorough renovation process wasiniticated to strip all ceiling and wall drywall and some wood flooring. Regardless I have been made essentially 'homeless' staying at acquaintances with few personal items and clothing. I am currently preparing to move again to a temporary accommodation till restoration work is complete. With this being an Ontario winter the question is when to replace the compromised roof and front window. I have yet to see any scope of work or timeline schedule.
What are my rights if any as a tenant and is there any compensation for my out of apartment stay or damages? As I see it, an accidental fire in an adjoining building (same landlord) has forced me out due to extreme smoke damage. Restoration work has commenced but due to the need to replace a roof structure in winter will require my absence. To date I have paid for moving and monthly storage as well as temporary rental until allowed back.
