Separated & New Common-Law Relationship -Question

Hi There,
Thanks for sharing your question and situation with us. We can appreciate that this is a confusing situation.
According to the CIC website:
Common-law partner
You are a common-law partner—either of the opposite sex or the same sex—if:
you have been living together in a conjugal relationship for at least one year in an ongoing 12-month period (you are allowed short absences for business travel or family reasons).
You will need proof that you and your common-law partner have combined your affairs and set up a household together. This can be in the form of proof of:
-joint bank accounts or credit cards. -joint ownership of a home. -joint residential leases. -joint rental receipts, -joint registration or payment of utilities (electricity, gas, telephone), -joint management of household expenses, -joint purchases, especially of household items, or -mail addressed to either person or both people at the same address.
However you may not be eligible to sponsor if you:
-did not meet the terms of a sponsorship agreement in the past, -did not pay alimony or child support even though a court ordered it, -get government financial help for reasons other than being disabled, -were convicted of -an offence of a sexual nature, -a violent crime, -an offence against a relative that resulted in bodily harm or -an attempt or threat to commit any such offences, depending on the detailss of the case, such as -the type of offence, -how long ago it occurred and -whether a record suspension was issued (see Sponsorship bar for violent crime below), -were sponsored as a spouse, common-law or conjugal partner in the past and became a permanent resident of Canada less than five years ago -did not pay back an immigration loan, made late payments or missed payments, -are in prison or -have declared bankruptcy and have not been released from it yet.
Other things not on this list may stop you from being able to sponsor a relative.
You may want to contact the Citizenship and Immigration Canada (CIC) Call Centre for more information regarding your specific situation and to confirm the information provided above.
You can also contact a lawyer or immigration consultant for help with your sponsorship application.
I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Temporary accommodation in Toronto

Hi there,
Thank you for sharing your question and situation with us.
For information about finding temporary accommodation, you may find the articles What kinds of short-term housing are available? and How can I find housing before I arrive? to be useful.
If you arrive at Lester B. Pearson International Airport in Toronto without a place to stay, you can look for the Immigrant Reception and Information Services (IRIS) kiosks in terminals 1 and 3. IRIS keeps a list of low-cost hotels and travellers' hostels in Toronto.
However, do not think only about cost. Make sure that the place you stay is clean, safe and conveniently located. Try to find a place that is close to public transportation or in the area where you would like to live.
We invite other users to share their experiences and recommendations on this topic.
I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Hi Silla,
Thanks for sharing your question and situation with us. We can appreciate that this is an emotional and frustrating time for you.
The agent we spoke with at the Landlord and Tenant Board suggested that you may wish to file a Form T2 - Application About Tenant Rights with them because what your landlord's doing is considered harassment and they are interfering with your reasonable enjoyment of your apartment.
You may also wish to contact a community legal clinic in your area to discuss your rights in this matter. You can find other legal resources in your area by calling 211 for free referrals and information.
I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

Questions About Sponsoring Dependents
Moderator
|
Hi There,
Thanks for sharing your question and situation with us. We can appreciate that this is a difficult situation.
You may find our article How do I sponsor a spouse, common-law or conjugal partner, or dependent child living outside of Canada? useful.
The CIC website has an explaination of your eligibility as a sponsor:
When you sponsor one of these relatives to become permanent residents of Canada, you must support them financially. This means you have to meet certain income guidelines.
If you have sponsored relatives to come to Canada in the past, and they have later asked the government for financial help, you may not be allowed to sponsor another person. Sponsorship is a big commitment, so you must take it seriously.
To be a sponsor you must:
agree in writing to give financial support to your relative, if they need it for a spouse or partner, this lasts for three years from the date they become a permanent resident, and for a dependent child, this lasts for 10 years, or until the child turns 25, whichever comes first. Your relative must also agree to try to support themselves.
You may not be eligible to be a sponsor if you:
-did not meet the terms of a sponsorship agreement in the past, -did not pay alimony or child support even though a court ordered it, -get government financial help for reasons other than being disabled, -were convicted of an offence of a sexual nature, a violent crime, an offence against a relative that resulted in bodily harm or -an attempt or threat to commit any such offences, depending on the detailss of the case, such as: the type of offence, how long ago it occurred and whether a record suspension was issued, -were sponsored as a spouse, common-law or conjugal partner in the past and became a permanent resident of Canada less than five years ago did not pay back an immigration loan, made late payments or missed payments, -are in prison or -have declared bankruptcy and have not been released from it yet.
Other things not on this list may stop you from being able to sponsor a relative.
You may want to contact the Citizenship and Immigration Canada (CIC) Call Centre for more information and to confirm the information provided above.
I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.

What are my healthcare options while we wait?

Hi There,
Thanks for sharing your question and situation with us. We can appreciate that this is a difficult situation.
You may find our article Where can I get health care if I don't have OHIP? useful.
It may also be important to note that CIC has recently made some changes to the sponsorship program:
Effective December 22, 2014, eligible spouses or common-law partners have the opportunity to work in Canada while they wait for their application for permanent residence to be processed. Citizenship and Immigration Canada (CIC) will issue open work permits to certain spouses or common-law partners who are applying for permanent residence from inside Canada, before the approval in principle decision on their application is made.
Given this information, if you are eligible for an open work permit, you may then be eligible for OHIP according to the Ministry of Health and Long-Term Care's website:
Open work permit holders may be eligible for Ontario health insurance coverage provided they are employed full-time for an employer in Ontario for a minimum of six months, have a valid work permit during this time, and they: -maintain their primary place of residence in Ontario; and are -physically present in Ontario for at least 153 days in any 12-month period; and are -physically present in Ontario for 153 of the first 183 days immediately after establishing residency in the province.
You may want to contact the Citizenship and Immigration Canada (CIC) Call Centre for more information and the Service Ontario to confirm the information provided above.
I hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.
