Hi there,

Thank you for sharing your question and situation with us, you may find helpful information in the discussion forum thread How Can I Travel With My Newborn?. Here is the excerpted response:
Hi there,

Thank you for reaching out! We’re happy to try and help with your question.

If you wish for your child to become a permanent resident of Canada, you and your wife must sponsor them to become a permanent resident. Sponsorship is, essentially, a promise to support a person after they have immigrated to Canada. More information on family sponsorships for your child can be found in the guide to sponsoring your spouse, common-law partner, or dependant child.

In general, to be eligible to sponsor your child, you must be able to prove you can provide for the basic needs of yourself, your spouse, the child you wish to sponsor and any other children of you or your spouse. As a permanent resident, you are unable to sponsor a family member while residing outside of Canada. In order to sponsor your child you must submit the application after one of the parents returns to Canada.

Due to issues resulting from the COVID-19 pandemic, permanent resident applications may be delayed. For this reason, it’s advisable to get the application for sponsorship submitted as soon as possible when you return to Canada. This application should be submitted first and then you should apply for your child to accompany your wife to Canada, and then apply for a visitor visa or electronic travel authorization for your child, since you mentioned that you would return to Canada first.

For your child to accompany your wife, she does not require written authorization from Immigration, Refugees, and Citizenship Canada (IRCC), but she must have the necessary documentation for travel. This includes documentation showing her status as a permanent resident, in the form of valid PR card or Permanent Resident Travel Document (PRTD), your child’s passport, your child’s birth certificate, a visa or eTA, and something proving your relationship, such as a marriage certificate. If the birth certificate is in a language other than English or French, it must be accompanied by an official, certified translation.

If your child is a citizen of a country that requires a visa to enter Canada then you would need a Temporary Resident Visa (TRV) for your child. Details on this process can be found in the guide to applying for a visitor visa. If your child is a citizen of a country that does not require a visa to enter Canada, they will need an electronic travel authorisation (eTA) to enter. A list of countries that are visa exempt can be found on the IRCC website.

As your child was born outside of Canada, IRCC will also require additional documentation proving your relationship. If your wife has any medical records about her pregnancy from Canada, this should be included in your applications. Additionally, IRCC may require DNA testing to prove the relationship between parent and child. As you can imagine, this is a precaution as Canada needs to be certain that they abide by the United Nations convention against human smuggling. This testing is overseen by IRCC, but you would be required to cover the costs. More details on DNA testing can be found on the IRCC website.

Please let us know if you have any other questions.

Sincerely,

Additionally, if you wish to sponsor your child when you return, and before your wife, you must be able to show that your wife agrees with your child immigrating to Canada.

COVID-19 has put a strain on wait times. For information specific to your application, it is best that you contact IRCC using their web form. It usually takes 2-5 days for IRCC to respond, however wait times for a response may be longer due to the COVID-19 situation.

COVID-19 has put a strain on wait times. For information specific to your application, it is best that you contact IRCC using their web form. Here is an excerpt from IRCC’s COVID-19 notice on Processing Times where you can also estimate the general processing time for this kind of application:

The impacts of COVID-19 have had an effect on our operations and our ability to respond to and process applications. We are therefore unable to provide processing timelines for specific applications at this time. Our current focus is on priority applications such as Canadians attempting to return to the country, vulnerable populations, and people who perform or support essential services, and we are trying to process those as quickly as possible.

IRCC is working on ways to finalize applications virtually. If you have a file in progress, check our website regularly for the most up to date information on the impacts of COVID on IRCC file processing.

Hi there,

Thank you for reaching out, and sharing your question with us.

We called the ServiceOntario INFOline at 1(866)532-3161, and the operator let us know that during the application process for PR, IRCC will send a letter that states it has been determined you have met the eligibility requirements for Permanent Residence. This can be shared with ServiceOntario as proof of approval-in-principle. It may be a good idea to also call the InfoLine to confirm this information, and share case-specific details to determine your wife's eligibility for OHIP.

Hi there,

Thank you for sharing your question and situation with us.

You may find helpful information in the Settlement.Org articles, How do I bring money into Canada (proof of funds)? and What should I consider when sending money overseas?

If you are looking to transfer money from your bank account to a Canadian bank account, you will need to speak with your financial institution before you come to Canada about currency laws and regulations in Canada and in the country you are leaving. There may be restrictions on the amount of money you can take out of the country. You may wish to contact Scotiabank by live chat or phone, you can find other ways to contact Scotiabank on their contact page.

We hope this information is helpful. Please feel free to follow up with us if you have any further questions.

What is the law for limit occupancy for housing?

Moderator

Hi there,

Thank you for sharing your situation and question with us.

According to the Ontario Human Rights Commission:

"Section 2 of the Code prohibits discrimination in housing based on family status. This right applies to renting, being evicted, building rules and regulations, repairs, harassment, and use of services and facilities. There is a lengthy history of families with children being turned away from housing because of negative perceptions associated with family status. These negative perceptions are compounded for young families, lone parent families, families from racialized and Aboriginal communities, and those in receipt of social assistance. The pattern of complaints received by the Commission, as well as social science evidence, indicates that this is a persistent, endemic problem in the rental housing market. The continued prevalence of “adult only” housing despite the clear prohibitions of the Code is a strong example of this.
As well, families face a range of systemic barriers to accessing housing. Families with young children, lone parent families, parents with disabilities or parents of children with disabilities, families from racialized communities and Aboriginal and newcomer families are disproportionately likely to be low income. The shelter allowance rates for families on social assistance are far below market levels. This, together with tight rental housing supply in many parts of the province, puts families at a significant disadvantage when seeking shelter.
Families identified by multiple Code grounds face a double disadvantage when seeking housing – for example, a family that includes a member with a disability must find shelter that is both accessible and accepting of children.."

You may want to connect with housing assistance services near you to help you with your search. Community agencies that provide housing assistance services will be able to support you in finding suitable accommodation for the short-term and long-term. If you feel that you are being discriminated against, you may also want to contact the nearest Community Legal Clinic for some advice regarding your situation.

It may also help to connect with a community resource navigator at 211 to narrow your search. 211 Ontario is a free, confidential service.

Their phone service is available 24 hours a day, 365 days a year. Here is a link to their live chat if you prefer to communicate online. Their live chat service is available Monday to Friday from 7am-9pm ET.

Hi there,

Thank you for sharing your question with us, and congratulations on your future engagement.

Marriage in Canada is an option available to all Canadian citizens and permanent residents who want to marry a foreign partner. But if you and your partner are visiting from another country, you don’t need to be citizens to marry.

You will still need to meet the requirements of the province you choose to get married. Each province has its own requirements. You can find detailed information regarding applying for Canadian Citizenship in our Settlement.Org article, Can I Get Married in Canada on a Visitor Visa?

In terms of the option of starting a sponsorship from within Canada, you can look at the different conditions that need to be met for sponsorship in our How do I sponsor a spouse, common-law partner or dependent child from inside Canada? article.

We hope this information is helpful. Please let us know if you have further questions and if there is any follow up to your question/situation.
